The State Department’s independent watchdog has issued a highly critical analysis of Hillary Clinton’s email practices while running the department, concluding that she failed to seek legal approval for her use of a private email server and that department staff would not have given its blessing because of the “security risks in doing so.”

The inspector general, in a long awaited review obtained Wednesday by The Washington Post in advance of its publication, found that Clinton’s use of private email for public business was “not an appropriate method” of preserving documents and that her practices failed to comply with department policies meant to ensure federal record laws are followed.
The report says she should have printed and saved her emails during her four years in office or surrendered her work-related correspondence immediately upon stepping down in February 2013. Instead, Clinton provided those records in December 2014, nearly two years after leaving office.

The report found that a top Clinton aide was warned in 2010 that the system may not properly preserve records but dismissed those worries, indicating that the system had passed legal muster. But the inspector general said it could not show evidence of a review by legal counsel.

A Clinton spokesman did not immediately resend to a request for comment.
The 83-page report reviews email practices by five secretaries of state and generally concludes that record keeping has been spotty for years.

It was particularly critical of former secretary of state Colin Powell — who has acknowledged publicly that he used his personal laptop to write emails — concluding that he too failed to follow department policy designed to comply with public-record laws.

The timing of the report is inconvenient for Clinton, who now faces an intense onslaught of attacks from presumptive Republican nominee Donald Trump.

But its release — as well as the conclusion of an ongoing FBI investigation — have also been seen for months by her allies as key milestones to finally putting the email issue to rest. They have worked to inoculate her against potentially critical findings, accusing the State Department’s inspector general of working in concert with congressional Republicans to harm her presidential campaign and noting that a top inspector general official used to work for Sen. Charles E. Grassley (R-Iowa).

The inspector general has rejected allegations of bias, noting that the scope of the review encompasses secretaries of both parties and that it was undertaken at the direction of Clinton’s Democratic successor, John F. Kerry. The report includes interviews with Kerry and Powell and former secretaries Madeleine Albright and Condoleezza Rice, but it says that Clinton declined to be interviewed. The inspector general, Steve Linick, was appointed by President Obama and has served since 2013.

The FBI investigation into whether Clinton mishandled classified material through her use of the private server in her home in suburban New York is still underway. FBI Director James B. Comey has said there is no “external deadline” for concluding that probe, but he acknowledged that there is pressure to wrap the matter up both promptly and thoroughly.

Officials have said they plan to interview Clinton about the matter soon; she has expressed willingness to sit for such a session. They have also told The Post that their investigation so far has found little evidence that Clinton maliciously flouted classification rules.

About 2,000 chains of Clinton’s correspondence include emails that the State Department has since said are classified. A Washington Post analysis found that Clinton herself wrote 104 of those notes. Others were written by about 300 other people, including longtime diplomats and top officials in the national security community.

The new report focuses on record keeping and how Clinton and previous secretaries of state have maintained documents regarding public business. She has said she complied with laws requiring the preservation of documents, including emails, because she emailed other government officials at their official accounts, knowing their emails would be retained on public servers.

However, she has not explained how she intended emails sent to private citizens, who did not use government email, to be preserved. Some emails have emerged, particularly from Clinton’s first months in office in 2009 when her aides have said she was transitioning technology, that she did not provide to the State Department.

In December 2014, nearly two years after leaving office, she turned over more than 30,000 emails she said represented all of her work related correspondence. She said she also exchanged about 31,000 personal emails during her time as secretary and those notes have been deleted.

Hillary Clinton expressed concern in November 2010 about the risk of her personal emails becoming accessible after one of her top aides said they needed to discuss putting her on the State Department’s email system.

The revelation of the exchange between Clinton and Huma Abedin was included in a report from the State Department’s inspector general that was released to lawmakers on Wednesday.

The report concluded that Clinton violated the agency’s email rules when she chose to exclusively use a private email server during her four years at State Department and did not promptly turn over records after she departed the agency.

The document also included some details of an exchange between Clinton and Abedin, who both chose not to cooperate with the IG’s investigation.

In November 2010, Secretary Clinton and her Deputy Chief of Staff for Operations discussed the fact that Secretary Clinton’s emails to Department employees were not being received,” the report said. “The Deputy Chief of Staff emailed the Secretary that “we should talk about putting you on state email or releasing your email address to the department so you are not going to spam.” In response, the Secretary wrote, “Let’s get separate address or device but I don’t want any risk of the personal being accessible.”

Hillary Clinton aide moves to block release of deposition video

Hillary Clinton's former chief of staff, Cheryl Mills, is asking a federal judge to order a conservative group not to release audio or video recordings of a deposition Mills is scheduled to give Friday about Clinton's use of a private email server during her tenure as secretary of state.

Mills' attorneys filed a motion Wednesday afternoon saying they fear that the group that sought Mills deposition in a Freedom of Information Act lawsuit, Judicial Watch, will use any recording to distort Mills testimony and advance the group's anti-Clinton agenda.

"We are concerned that snippets or soundbites of the deposition may be publicized in a way that exploits Ms. Mills’ image and voice in an unfair and misleading manner," attorneys Beth Wilkinson and Alexandra Walsh wrote in the motion submitted to U.S. District Court Judge Emmet Sullivan. "Ms. Mills is not a party to this action. She is a private citizen appearing voluntarily to assist in providing the limited discovery the Court has permitted... Judicial Watch should not be allowed to manipulate Ms. Mills’ testimony, and invade her personal privacy, to advance a partisan agenda that should have nothing to do with this litigation."

The motion says Mills has no objection to releasing the transcript of her testimony, although the State Department has said it may object if the testimony strays into areas supposed to be off limits according to the judge's order permitting the deposition.

Mills' filing asserts that audio or video clips would be more easily taken out of context than a transcript, but does not make entirely clear why written quotes could not be similarly distorted.

Sullivan issued an order shortly after the motion was filed giving the conservative group until noon Thursday to offer a formal response to the motion.

A spokeswoman for Judicial Watch said the group is evaluating the motion and will respond by the judge's deadline.

In addition to Mills, former Clinton Deputy Chief of Staff Huma Abedin and computer technician Bryan Pagliano are scheduled to give depositions in the coming weeks. It's unclear whether any limits put on videos of Mills' testimony would be applied to their appearances, but if the judge agrees to Mills' request it seems likely the others would ask for similar treatment.

One current State Department official gave a deposition last week and several others are expected to do so over the next month or so in accordance an order SUllivan issued earlier this month.

Sullivan has left open the possibility of calling Clinton for a deposition in the case. Judicial Watch has already formally asked a judge handling a parallel case to order Clinton to give testimony but there's been no ruling on that request.
