here is my text durring the public comment on personnel
In light of the recent executive decisions offered by our Supervisor in the past year and a few months I have decided to do some research on the division of powers between the town board and the town supervisor.
I will start with a quote taken directly from the History page of the rotterdamny.org the town web site.
“Established as a first class town in 1942, Rotterdam has since adopted the seal of the Old World Rotterdam, along with its motto, "Stronger Through Effort." Through diligent application of this motto, Rotterdam looks confidently to the future.”
It is an obligation of our town board members and Supervisor to familiarize themselves with NYS town law, the local government handbook and the supervisor fully understand his powers as described under Article 3 Section 39 of NYS Town Law.
I have spoken with New York State Department of State on this subject and was provided with a much simpler description of the powers as not all of us are lawyers.
This information is taken from the Local Government Handbook sixth addition dated 2009.
I will read a few easily understandable excerpts from the handbook for everyone’s benefit.
One of the distinguishing features of town government organization is the lack of a strong executive branch. Virtually all of a town’s discretionary authority rests with the town board. What little executive power the supervisor has is granted by specific statute or by the town board.
The town board, therefore, exercises both legislative and executive functions.
Executive Leadership Supervisor: The Town Law does not provide for a separate executive branch of town government. Because the supervisor occupies the leader’s position on the town board, and because town residents often turn to the supervisor with their problems, many people think the supervisor’s position is the executive position of town government. But the supervisor is part of the legislative branch and acts as a member and presiding officer of the town board. He or she acts as a full member of the board, voting on all questions and having no additional tie-breaking or veto power.
The supervisor is more of an administrator than an executive. The supervisor’s duties under law are to: • act as treasurer and have care and custody of monies belonging to the town; • disburse monies; keep an accurate and complete account of all monies; • make reports as required; pay fixed salaries and other claims; • lease, sell, and convey properties of the town, when so directed by the town board.
The basic source of the supervisor’s power lies in the position’s traditional political leadership and the holder’s ability to use this leadership. Familiarity with day-to-day problems of the town often enables the supervisor to influence the policy decisions of the town board.
You should notice that nowhere in the simple text above was the supervisor allowed to act as an individual in maters concerning matters of employment and direct instruction to town employees or officers.
The New York State Legislature has authorized towns to adopt local laws superseding many specific provisions of the Town Law. The purpose of this legislation was to allow towns to restructure their form of government to provide for an executive or administrative branch separate and apart from the legislative branch of government.
A detailed review of our town laws which our town web site misleadingly calls code reveals none.
In front of this board I am demanding: • A review of all independent decisions made by our supervisor. • A public apology on the abuse of power. • Immediate resolution returning the funds to the proper departments for the return of the employees affected by these unlawful decisions. • A resolution directing the town employees to return to their past positions as of the second day this supervisor took office. • A resolution directing the ethics board to investigate all actions involving independent decisions made by our supervisor as described in section 31-5 of the Laws of the Town of Rotterdam in which the Supervisor has chosen to represent the Town Board without direction from the Town Board in addition to the request I will submit.

In ref to Change of Zone Request for Tax Map Number 57.00-3-16 located on the east side of Feuz Road, north of the intersection of CountryWalk Road, Rotterdam, from Agriculture (A-1) to Multi-family Residential (R-3) I STRONGLY oppose.
Multi-family zoning is not in keeping with the area, it appears to be a spot zone because Becker Drive is now B-2, West side of Feuz (north of CW) light Industrial and SE Corner of Feuz/Country Walk is Agricultural/Residential along with the rest of the surrounding area.
It is a not a logical fit and would not add value to the area. It would destroy the character of an existing single family home neighborhood.
We are concerned with the impact this change would have on the safety of the community. Rental Property is not always kept up as nicely and statistically tends to increase crime reports. Even a nice apartment building does not ensure that in 10 years it wouldn’t be run down. I think the neighborhood would be better served with single family owned housing.
A property development of this sort would have a severe negative impact on our property value.
We are concerned about the environmental impacts, such as the impact of runoff from the area to direct downhill neighboring single family homes. We have a ‘creek’ (a runoff water way) that runs through the front of our property that comes directly from the property that is requesting a zone change. We are very concerned about the impact of so many apartment unit buildings and septic systems would have on the interruption, pollution (producing bacteria) and/or overflow of this waterway.
But Most Importantly… Do we really need more apartments in Rotterdam? We are already saturated with multi-family dwellings, and have enough multi-family living options. The dwellings that do exist, like Long Pond Village ……, are not filled to capacity, they have units currently available. There are plans to build even more apartments units, (re-zoned and approved by Rotterdam already)approx 248, new garden apartment units on North Thompson Street and the Zoning Board of Appeals also approved 54 new units on Carmen Road. Not to mention another zone change request for 16 new apartments at 1952 Curry Rd. We can’t fill the apartments we currently have in Rotterdam and there too many new ones on the horizon. What is the purpose or benefit of apartment units in this location? Increased revenue to one person or a few that own the apartments while creating a decreased benefit to the community and Rotterdam. Apartments would lower the value of existing homes and make it less appealing for people to live here and ultimately less money in taxes to Rotterdam. Shouldn’t our goal really be gain for the community and Rotterdam not to put money in the pockets of a select few. Again … the neighborhood and Rotterdam would be better served with a more suitable project like single family owned homes which would ultimately create more revenue to the town.
On an even more personal level – I have lived in Rotterdam since 1992 with my husband Phil. We lived/owned a modest house off Altamont Avenue for 16years. My husband was born in Rotterdam and has lived here since. He has many family members that reside here, mother, aunts, uncles and cousins. When my husband and I had our 2 boys, now 7, we knew we had to start looking for house/neighborhood in which to raise and build a foundation for a family. We spent 2years looking and finally ended up where we are now on Country Walk. We very carefully selected the neighborhood and schools. We used everything we had so diligently worked for, scrimped, saved and sacrificed over the years. We used EVERYTHING we had to settle our family here, but felt it was worth it for the foundation we would be providing our boys. My boys play on their swing set in the backyard, climb trees in the front yard, ride their bicycles and play basketball in our driveway. They have their friends over and play comfortable around our house. If you drive by our house on any given weekend in March through November you would more than likely see my husband and I working in the yard, striving to make it look nice, clean and well maintained. Proud of the work we have accomplished with our own hands, hard work, and determination. My husband Phil took down 80 trees alone the first year we lived there. We knew there was vacant land around and near us, BUT we were and are surrounded by established and newly developed houses. I believe we had reasonable expectation that the zoning would not change. It seemed a single family housing neighborhood precedent had been set. We are long time Rotterdam residents and pay approx $10,000.00 in combined school/county taxes per year. We strongly believe this certainly gives us the right to expect that our voices and opinions should without doubt have a bearing on the decisions that directly affect our neighborhood. I ask that you please take this into consideration when making your decision.

Unfortunately I was out of the Council Chamber when the BLS resolution came up...and Calder asked to table for no reason...at least not for a valid reason...this has TJ written all over it. Those who were at the agenda meeting on Monday may have noticed him silently lurking around outside the meeting room...undoubtedly interested on the EMS contract resolution.
There wasn't a single word mentioned about the resolution...or reason to believe it would not be passed...which is why TJ likely called on his ally, Wayne Calder....who simply asked to table the measure...for no reason. Any discussion of "bids" on the service is ridiculous...the Town will not spend money on that contract which makes the bidding process unnecessary...which is why the resolution originally assigned FDG to negotiate that contract.
The only reason TJ wants bidding is to drag us through another REMS scandal...still desperately trying to hang on to REMS and a gravy train for them..apparently he doesn't think the last 9 or 10 years of deceptive claims was long enough...and now that REMS is left with no choice but to run their operation like a business, as they should have been doing all along, suddenly they don't need LOCAL tax dollars for their "capital" investments...the Feds gave them public money instead...and now suddenly they can provide the service at no cost to taxpayers...to which I say, forget it.
Rest assured TJ arranged for this delay...he does not want FDG negotiating that contract because he knows FDG will never give REMS that contract, even though he would be completely justified in refusing REMS.
That BLS contract is critical...the contractually designated ems provider would be the first called and dispatched to emergencies..which means that provider would be the primary biller and collector of ALS funds for paramedic service. At this time, naturally REMS is the first called...Mohawk is last on the dispatch list. The only way to reverse that protocol is through that BLS contract.
Given the history of the REMS/ALS rip off...under no circumstance should REMS even be considered for that contract. For all we know, REMS may still be collecting that cash...I'm not saying they are...I'm saying they could, and likely get away with it. Why? Because the PD only records the number of calls in which the paramedics are dispatched...the nature and locations...but they have no responsibility to oversee or record billing, or amounts collected...and those patient billing records are protected under HIPPA. The only difference here, as opposed to the years of stolen funds, is that they would be doing it on their own, without the unauthorized blessing of the former Supervisor. All they have to do is not record the collections, just as they did while they were illegally keeping money that belonged to the Town.
I explained all of this to FDG last week...that's why the resolution was on the agenda...and he should never have allowed it to be tabled again...we are losing significant amounts of money everyday...but TJ would rather lose that cash and drag it out to continue in a desperate attempt to give REMS that contract than to give it to Mohawk..who would have been turning that money over to the Town all the time TJ and the union bandits were trying to scam the public into an unnecessary tax.

Because the PD only records the number of calls in which the paramedics are dispatched...the nature and locations...but they have no responsibility to oversee or record billing, or amounts collected...and those patient billing records are protected under HIPPA. The only difference here, as opposed to the years of stolen funds, is that they would be doing it on their own, without the unauthorized blessing of the former Supervisor. All they have to do is not record the collections, just as they did while they were illegally keeping money that belonged to the Town.
I explained all of this to FDG last week...that's why the resolution was on the agenda...and he should never have allowed it to be tabled again...we are losing significant amounts of money everyday...but TJ would rather lose that cash and drag it out to continue in a desperate attempt to give REMS that contract than to give it to Mohawk..who would have been turning that money over to the Town all the time TJ and the union bandits were trying to scam the public into an unnecessary tax.
This is yet another reason to not vote for dems....at least not in rotterdam!! It is apparent that since TJ Hooker is in control, it is obvious in what direction they will sway. It won't be to benefit the taxpayers in rotterdam.
It also appears that FDG is the ONLY one who will not walk in lock step with the dem's agenda.
