ELECTION 2008: The Legal Ties That Bind the Bidens

Although he hasn't practiced law in over 30 years, newly-minted vice presidential nominee Joe Biden remains a favorite son in the legal community.
Like all potential VPs, Joe Biden was thoroughly vetted by the Obama campaign, his relationships to lobbyists carefully analyzed. The Am Law Daily did some of its own vetting of the new nominee and the extensive legal ties that bind the Bidens. Older son Beau, 39, followed his father into politics, and is currently the attorney general of Delaware. Younger son Hunter is a partner at Oldaker, Biden & Belair, a Washington law and lobbying firm. Hunter stepped down from the firm's lobbying affiliate in 2006 in keeping with a Senate ethics bill requirement. His firm was retained as legal counsel to the Biden campaign and paid more than $57,000 this year.
The senator has longstanding relationships with law firms that donated to his congressional races and his two bids for the White House. Top contributors for his recent run were the Law Office of Peter Angelos in Baltimore, Maryland, which donated $156,250; SimmonsCooper in East Alton, Illinois contributed $146,600; Pachulski Stang Ziehl & Jones in Wilmington gave $145,625; and Young Conaway Stargatt & Taylor in Wilmington gave $127,979.
Many of those firms have handled asbestos and bankruptcy cases, issues Biden has weighed in on from his seat on the judicial committee. Biden was a critic of the failed Fairness in Asbestos Injury Resolution (FAIR) Act of 2005, which would have trimmed returns on future litigation and hurt firms like SimmonsCooper, a billion dollar asbestos practice which used son Beau's former law firm, Bifferato, Gentilotti, Biden & Balick (now Bifferato Gentilotti), as local counsel to file asbestos suits in Delaware. Angelos' firm also represents asbestos clients, and Stargatt & Taylor has handled mass tort asbestos cases, representing court-appointed advocates for unknown future claimants--individuals representing people who have been exposed to asbestos but have not yet become sick.
On the other side of the asbestos issue, Pachulski Stang, a bankruptcy boutique, counsels companies that filed for Chapter 11 after being hit with a multitude of asbestos claims. A firm partner tells The Am Law Daily their support for Biden had little to do with his views on legal issues and more to do with his popularity in Delaware.
One of Biden's most controversial legal donors was Richard Scruggs, the Oxford, Mississippi asbestos and tobacco plaintiffs attorney who was convicted of trying to bribe a federal judge. Scruggs, his family, and his  associates Timothy Balducci and Stephen Patterson (the two have pleaded guilty to bribery charges), gave $11,500 to Biden this year. (The Scruggs family also donated to Senator McCain's campaign.) In July, Biden's campaign cleaned house and donated the money to charity.
But the Biden campaign looked to family connections to dispose of the tainted funds, handing the money over to the National Prostate Cancer Coalition--where son Hunter sits on the Board of Directors.

He almost wrecked Barack Obama's presidential dreams, and now firebrand pastor Jeremiah Wright has helped destroy a Dallas church worker's marriage - and her job, The Post has learned.

Elizabeth Payne, 37, said she had a steamy sexual affair with the controversial, racially divisive man of the cloth while she was an executive assistant at a church headed by a popular Wright protégé.

When word of the unholy alliance got out, Payne's husband dumped her, and she was canned from the plum job at Friendship-West Baptist Church, she told The Post.

"I was involved with Rev. Wright, and that's why I lost my job and why my husband divorced me," Payne said.

She refused to reveal when the adulterous affair started or how she met Wright.

But fellow churchgoers at Friendship-West "found out about the affair in the spring," Payne said.

At the time, she was secretary to the Rev. Frederick Haynes III, a longtime Wright disciple.

In April, Payne organized a series of Texas public appearances by Wright, 67. Weeks before, Obama had disavowed his preacher of 20 years after Wright's anti-government rants came to light.

"Liz was by Rev. Wright's side day and night during those days," a church source said.

"It's all true," said Payne, adding that she has filed a wrongful-dismissal claim with the Equal Employment Opportunity Commission to get her job back.

In an ironic twist, Wright last night spoke at an East Orange, NJ, church revival on the subject of "unexpected problems."

"There's no such thing as a problem-free relationship," he told a packed Elmwood United Presbyterian Church. "In life, you'll have unexpected problems."

He punctuated his 45-minute sermon with evocative 1960s hits, including the Supremes' "Where Did Our Love Go," Frankie Beverley's "Joy and Pain," and the Temptations' "Ain't Too Proud to Beg." He's set to speak there again tonight.

Payne's husband, Fred Payne, 64, said he learned of the affair in late February, when he discovered e-mails between his wife and Wright.

"There must have been about 80 of them, back and forth," he said. "Wright said things like he was going to leave his wife for Elizabeth."

Wright has been married to his second wife, Ramah, for more than 20 years.

The preacher reportedly wooed Ramah away from her first husband in the 1980s, when the couple came to marriage counseling at Wright's Trinity United Church of Christ in Chicago.

After discovering he had been cuckolded, Fred Payne, who had married Elizabeth in October 2006, headed straight for divorce court.

"I was downright mad about this bull- - - -," said Fred, who said he is "in the oil and gas business," belongs to a hunting club and makes his own bullets in his garage.

"People wouldn't be happy to know that my wife was sleeping with a black man."

He added, "Rev. Haynes doesn't like the interracial thing, either. This was quite an issue for him."

Elizabeth Payne said she has been banished by Haynes and the flock at Friendship-West.

"I'm not a member of the congregation anymore; I'm not even allowed on the premises," she said.

Wright became an embarrassment for Obama after videos of the preacher's old sermons emerged.

In them, Wright blamed the United States for the 9/11 attacks and boomed, "God damn America!"

Democratic Vice Presidential Candidate Joe Biden's lobbyist son and brother are accused of defrauding a former business partner and an investor of millions of dollars.

R. Hunter Biden is one of Senator Joe Biden's (D-DE) three children. He was a founding partner of Oldaker, Biden & Belair, a D.C. lawyer-lobbyist shop, served as a Senior Vice President at a major financial services firm and most recently was a Presidential appointee at the U.S. Department of Commerce, where he served as the Executive Director for e-Commerce Policy Coordination under Transportation Secretary" Norman Y. Mineta during the Clinton administration... In 2003, he got a $100,000 annual retainer from MBNA to advise the company on 'the Internet and privacy law. MBNA is Senator Biden's biggest contributor. A son and a brother of Sen. Joseph R. Biden Jr. (D-Del.) are accused in two lawsuits of defrauding a former business partner and an investor of millions of dollars in a hedge fund deal that went sour, court records show.

The Democratic vice presidential candidate's son Hunter, 38, and brother James, 59, assert instead that their former partner defrauded them by misrepresenting his experience in the hedge fund industry and recommending that they hire a lawyer with felony convictions.

The legal actions have been playing out in New York State Supreme Court since 2007, and they focus on Hunter and James Biden's involvement in Paradigm Companies LLC, a hedge fund group. Hunter Biden, a Washington lobbyist, briefly served as president of the firm.

A lawsuit filed by their former partner Anthony Lotito Jr. asserts in court papers that the deal was crafted to get Hunter Biden out of lobbying because his father was concerned about the impact it would have on his bid for the White House. Biden was running for the Democratic nomination at the time the suit was filed.
The suit against Hunter Biden was previously reported in January 2007.

Joe Biden does not talk much about his son's lobbyist background. Hunter Biden lobbied for clients that paid his firm at least $380,000 in the first six months of this year, federal records show.

Obama’s $100,000 garden grant wasted, Obama corruption, Chicago Suntimes, July 11, 2008, Illinois state senator, $100,000 state grant, Obama and corrupt grants

Barack Obama is documented to have close ties to corruption and crime in Chicago and Illinois. The Tony Rezko trial revealed Obama’s close, long time ties to Rezko, Blagojevich, Stuart Levine and a host of dubious characters. Obama has also been documented to have been involved in securing grants from the state of Illinois for many projects that were suspect or tied to criminals. Obama and his former campaign manager, Dan Shomon, secured state grants for Robert Blackwell companies. Shomon, while campaign manager for Obama, worked for Blackwell. Robert Blackwell companies gave over $ 30,000 to the Obama campaign in 2007.

The Chicago Suntimes, in an article dated July 11, 2008, reveals another large grant obtained by Obama and this deal really smells. Here are some excerpts from the article:

“Kenny B. Smith, a onetime campaign volunteer for Barack Obama, can’t explain exactly how he spent $100,000 of taxpayers’ money on a garden that was never built.”

“As a state senator, Barack Obama gave $100,000 in state money to a campaign volunteer who failed to deliver on a plan to create a botanic garden in one of Chicago’s most blighted neighborhoods.

Obama — who was running for Congress when he announced the project in 2000 — said the green space in Englewood would build ”a sense of neighborhood pride.”

Instead, what was supposed to be a six-block stretch of trees and paths is now a field of unfulfilled dreams, strewn with weeds, garbage and broken pavement.”

“Smith — an early Obama supporter who gave $550 to his state and congressional campaigns — said he gave his paperwork documenting the work to a state agency and no longer has it. A Department of Commerce and Economic Opportunity spokeswoman said officials would look into the matter.”

Obama-Ayers: Failed Chicago Schools Under Ethnic Identity Agenda

Angry Obama supporters were asked to contact WGN’s 720 Extension radio talk show en masse to encourage the station to drop an interview with Stanley Kurtz, a National Review Online contributor with new information on Barack Obama. The show went on.

No secret now, why the Obama Campaign is desperately trying to silence National Review Online’s Stanley Kurtz.

Milt Rosenberg’s two-hour interview on WGN Radio last night with Kurtz revealed some of the agenda behind a late 1990’s Chicago public school program, of which Barack Obama was at the helm.

When news of the pending interview broke, the Obama campaign sent out emails, detailing talking points, and asking supporters to flood the radio station with calls and email messages, which they did. (The Obama Wire email appears at the end of this article.)

The Obama campaign was offered to participate in the entire two hour interview. According to Rosenberg’s producer, after the offer was made, a high-level Obama staffer asked for the name of the station manager and then hung up on the producer.


Background and my synopsis of the interview:
The University of Illinois released documents yesterday that propelled this conversation forward. Barack Obama and Weatherman terrorist Bill Ayers, who spent a number of years on the FBI’s Ten Most Wanted List, were the leading powers behind a massive educational reform for the city of Chicago. Then Secretary of Education, William Bennett stated that the Chicago educational system was the worst in the Nation.

William Ayers prepared the proposal that got the seed money for the education reform program that would become the Chicago Annenberg Challenge - some $50M from the Annenberg Foundation, which was then matched by philanthropists and business interests - to total over $100M for Chicago’s failing school system.

With the money came the need for a organization - hence the Chicago Annenberg Challenge (CAC) was formed. The Chairman of the Board was Barack Obama. William Ayers was an ex-officio board member. The two attended meetings together…how often is not yet known.

Obama and Ayers presided over a very powerful political duo: The CAC headed by Obama and The Collaborative, co-chaired by Ayers.

It allegedly worked like this: “Programs” would apply to the CAC for an educational grant. Some programs were chosen, and others were not. Before the CAC was disbanded, almost all, if not all, of the monies were spent.

Kurtz, reading from yesterday’s released documents, gave these examples of who or what received the grants:

Chosen to receive a grant:
The South Shore African Village Collaborative for their “Celebrate African-American Holiday of Juneteenth” (celebrating the Emancipation Proclamation). Some African-Americans celebrate Juneteenth instead of the Fourth of July (a report fromTexas). Kurtz commented that in his reporting of Obama’s previous church, Trinity United Church of Christ, some members told him that Juneteenth was their Independence Day, not Fourth of July (Kurtz did not say that all members held this view).

Turned down to receive a grant:
*The Chicago Algebra Project: goal to increase student achievement

*The District 5 Math Initiative: goal to aid Hispanic students in the process of learning English, to further learn math and science.

Kurtz characterized the information he viewed as showing grant preferences for ethnic identity projects. The grants were evidently not given to schools, but rather to “external partners,” to which schools sought to attach themselves - such as a South Shore African Village Collaborative.

In the meantime, after “external partners” received millions, ethnic identity didn’t help math and science scores. It is interesting to note that this Chairman of the Board position was Obama’s first “executive” experience.

There’s more: Obama’s connections to the Gamaliel Foundation, Kurtz says has a “core point” advocating for a form of “liberation theology.” He further states that his research shows that Jeremiah Wright’s Black Liberation Theology preaching is not an anomaly.

Kurtz refers to a book written by Dennis A. Jacobsen, Doing Justice - Congregations and Community Organizing. This book, according to Kurtz, embodies the views of the Gamaliel Foundation. Further he asserts that Greg Galluzo, “the most important figure” in the Gamaliel Foundation, approves Jacobsen’s book, and is also an Obama mentor. Kurtz believes that Obama was a teacher at the Gamaliel Foundation before Jacobsen wrote the book. Kurtz does not know whether Obama has read the book.

The last portion of the interview was given to callers and emails, most of which were angry that Kurtz was allowed radio time. One emailer confused Kurtz with Weekly Standard editor, Bill Kristol, referring to “the vile traitor Bill Kristol.” Another asked about FCC oversight of the “unbalanced” station.

It was striking that few callers had anything to say more than the email’s talking points. Some pulled out the constant whine that Obama was only eight years old when the Weathermen were bombing our U.S. Capitol, the Pentagon, the State Department building, etc. They further pointed out Obama has “denounced” William Ayers. He did not, however, denounce him until he was forced to for the sake of his political campaign, and he wasn’t eight years old when he and Ayers began their educational reform.

Well shadow, a very interesting article! This guy is bad news for this country if elected. I'll betcha 'juneteenth' (whatever that is) would end up becoming a national holiday. Like we need another. Obama has taken a dive in the polls since Palin came on board. For the first time in my recent memory and also being a bit scary, that a vice presidential candidate has taken the lime light away from the presidential candidate. Strange!

ABC News' Matthew Jaffe Reports: Barack Obama's vice-presidential nominee Sen. Joe Biden, D-Del., Wednesday said that Sen. Hillary Clinton, D-NY, might have been a better pick for the position than him.

At a rally in Nashua, New Hampshire, a man in the audience told Biden how glad he was that Obama picked him over Hillary "not because she's a woman, but because look at the things she did in the past."

"Make no mistake about this," Biden responded. "Hillary Clinton is as qualified or more qualified than I am to be vice president of the United States of America. Let’s get that straight. She’s a truly close personal friend, she is qualified to be president of the United States of America, she’s easily qualified to be vice president of the United States of America and quite frankly it might have been a better pick than me. But she’s first rate, I mean that sincerely, she’s first rate, so let’s get that straight."

Spokesman Ben Porritt  offered this response from the McCain camp: "Barack Obama’s most important decision of this election and Biden - the candidate he selects - suggests himself that he wasn’t the right man for the job and that Hillary Clinton would have been a better choice. Biden certainly has a credible viewpoint on this."

Obama On Letterman: 'McCain Policy Is The Pig'
Presidential Hopeful Says Media Took His Words And Ran; Defends Bush Policies On Afghanistan, AIDS In Africa
NEW YORK (CBS) ― Presidential hopeful Barack Obama appeared on the "Late Show with David Letterman" in New York on Wednesday after a day of heated debate by media and political pundits over comments some took as a slam against Republican vice-presidential candidate Sarah Palin.

Obama spent much of his visit talking about Palin and clarifying his earlier comments.

"This is sort of silly season in politics, not that there's a non-silly season, but it gets sillier," Obama said. "And it's a common expression in at least Illinois. I don't know about New York City. I don't know what you put lipstick on here."

Obama said to him the expression "lipstick on a pig" in this case applies to having a bad idea and trying to pass it off as change.

"Just calling [ideas] change, calling them different doesn't make it better, hence lipstick on a pig," Obama said.

He then clarified his statements even more.

"Keep in mind, technically, had I meant it this way, [Palin] would be the lipstick. The failed policies of John McCain would be the pig, just following the logic of this illogical situation," Obama said.

Earlier in the day, Obama accused Republican McCain's campaign of using "lies and phony outrage and Swift-boat politics" in claiming he used a sexist comment against Palin.

Calling it "the latest made-up controversy by the John McCain campaign," Obama responded to the Republicans' charge that he was referring to Palin when he used the phrase "lipstick on a pig" at a campaign stop Tuesday.

"I don't care what they say about me. But I love this country too much to let them take over another election with lies and phony outrage and Swift-boat politics. Enough is enough," he said.

During his visit with Letterman, Obama talked about visiting Disneyland, boyhood memories, joking with his 87-year-old grandmother and embarrassing his daughters on their first day back to school.

Obama said his grandmother's reaction when he won the nomination was pretty simple: "That's nice, that's nice."

Obama praised President George W. Bush's efforts to send aid to countries in Africa. Obama, whose father was Kenyan, visited the African country in 2007.

"People there are more energetic and optimistic than you could possibly imagine," said Obama.

Regarding rumors of former president Bill Clinton's future as part of an Obama administration cabinet, the senator downplayed that possibility.

"If you're a former president, I don't think you settle for a cabinet position," he said. "It's sort of like Mickey Mantle playing AAA (baseball).

"There's nobody smarter in politics," Obama said of Bill Clinton. "I think he can be a great advocate for the campaign."

I know everyone has a different opinion on the war and our current
President. But, this article makes a lot of sense, take 2 minutes, read
it and give it some thought.
When electing the next President, 'the only decision you have to
make is who you want sitting in that seat in the White House when - not
if- WHEN we get hit again and millions of American lives are put at
risk!'

President Bush did make a bad mistake in the war on terrorism. But
the mistake was not his decision to go to war in Iraq. Bush's mistake
came in his belief that this country is the same one his father fought for in
WWII. It is not.

Back then, they had just come out of a vicious depression. The
country was steeled by the hardship of that depression, but they still
believed fervently in this country. They knew that the people had
elected their leaders, so it was the people's duty to back those leaders.
Therefore, when the war broke out the people came together, rallied
behind, and stuck with their leaders, whether they had voted for them or
not or whether the war was going badly or not.

And war was just as distasteful and the anguish just as great then
as it is today. Often there were more casualties in one day in WWII than
we have had in the entire Iraq war. But that did not matter.. The people
stuck with the President because it was their patriotic duty. Americans put
aside their differences in WWII and worked together to win that war.
Everyone from every strata of society, from young to old pitched
in. Small children pulled little wagons around to gather scrap metal for
the war effort. Grade school students saved their pennies to buy stamps for
war bonds to help the effort.

Men who were too old or medically 4F lied about their age or
condition trying their best to join the military.

Women doubled their work to keep things going at home. Harsh
rationing of everything from gasoline to soap, to butter was imposed,
yet there was very little complaining.

You never heard prominent people on the radio belittling the
President. Interestingly enough in those days there were no fat cat
actors and entertainers who ran off to visit and fawn over dictators of hostile
countries and complain to them about our President. Instead, they made
upbeat films and entertained our troops to help the troops' morale. And
a bunch even enlisted.

And imagine this: Teachers in schools actually started the day off
with a Pledge of Allegiance, and with prayers for our country and our
troops!

Back then, no newspaper would have dared point out certain weak
spots in our cities where bombs could be set off to cause the maximum
damage. No newspaper would have dared complain about what we were doing
to catch spies. A newspaper would have been laughed out of existence if it
had complained that German or Japanese soldiers were being 'tortured' by
being forced to wear women's underwear, or subjected to interrogation by a
woman, or being scared by a dog or did not have air conditioning.

There were a lot of things different back then. We were not
subjected to a constant bombardment of pornography, perversion and
promiscuity in movies or on radio. We did not have legions of crack
heads, dope pushers and armed gangs roaming our streets.
No, President Bush did not make a mistake in his handling of
terrorism. He made the mistake of believing that we still had the
courage and fortitude of our fathers. He believed that this was still the
country that our fathers fought so dearly to preserve.

It is not the same country. It is now a cross between Sodom and
Gomorra and the land of Oz. We did unite for a short while after 9/11,
but our attitude changed when we found out that defending our country would
require some sacrifices.

We are in great danger. The terrorists are fanatic Muslims. They
believe that it is okay, even their duty, to kill anyone who will not
convert to Islam. It has been estimated that about one third or over
three hundred million Muslims are sympathetic to the terrorists cause...
Hitler and Tojo combined did not have nearly that many potential recruits.

So...
We either win it - or lose it - and you ain't gonna like losing.
America is not at war. The military is at war.
America is at the mall, or watching the movie stars.
(Remember Obama said in his book 'Audacity of Hope', 'I will stand
with the Muslims should the political winds shift in an ugly
direction'.....what better place for the Muslins to control our country,
than in the office of the President of USA .

Obama’s agenda lots clearer than McCain’s

    Sidney Woodcock’s Sept. 6 letter [“Beware the Obama who surfaces after the election”] said he really didn’t know Barack Obama, or what he intends to do as president. Well, look at his Web site (barackobama.com) and his record, and you’ll see Obama wants to bring the troops home from Iraq.
    He was against this oil war from Day One. He wants us to stop spending hundreds of billions of taxpayer dollars on war, and instead develop energy independence, with clean energy. Energy produced here means good-paying jobs here. McCain wants to continue with more war, and more giveaways to the oil companies that are paying for his campaign.
    Obama want to give tax cuts to working families, and reverse the Bush tax giveaways to the richest. McCain wants to continue Bush’s giveaways to the very richest, who are paying for his campaign.
    Obama wants to protect Social Security, while McCain wants to turn it over to Wall Street speculators. Obama wants health care for all Americans, while McCain is out to protect the insurance companies.
    Woodcock decries increases in government spending . But let’s remember that Bush took Clinton’s surplus and turned it into record trillions in defi cits — all because of war, corporate welfare, tax giveaways to the rich. Obama and the Democrats are the true fiscal conservatives.
    Obama has been consistent in his positions; we know what he will do as president. McCain has flip-flopped on tax giveaways, torture and many other issues, but is clearly another Bush (he’s voted with Bush 90 percent of the time).
    If you want more war, more recession, more corporate cronyism, vote McCain. If you want peace, energy independence, good jobs, health care, education, and a restoration of America’s dignity, vote Obama.
