A City Council member is suing a prominent city property owner over an injury she said she suffered on his property last winter.

   The suit was filed by attorney Charles Harding on behalf of Marion Porterfield. Named as defendants are Frank Popolizio, owner of 1703 Union St., and a business he apparently leased the property to, One Huge Savings or One Huge Sale.

   The suit relates to a fall Porterfield said she occurred in the property’s parking lot Jan. 25. She badly injured her elbow in the fall, Harding said.

   The suit attributes Porterfield’s fall to snow and ice buildup that wasn’t properly cleared or treated, making the parking lot slippery. The suit alleges her injuries were caused by negligence by the defendants in failing to properly maintain the parking area.

   Reached Wednesday, Harding said he’s tried repeatedly to contact Popolizio and the business, to no avail.

   “Neither one of them has responded to our letters, and no one has put us in touch with the insurance company,” he said.

   That forced him to file the suit.

   “Somebody failed to properly maintain the parking lot, either the owner or the tenant,” Harding said.

   Porterfield said Wednesday she had yet to be informed the case had been filed. She also said she had not known previously that Popolizio was the property owner.

   Popolizio declined to comment when contacted Wednesday, citing past instances where his attorney advised him not to comment publicly about legal issues. He has faced numerous legal issues in the past, including allegations over the years of overdue property taxes, property maintenance issues and code violations.

   The case was filed Friday in state Supreme Court in Schenectady County.

FP is sleazy. He stole items that we had in a shop, he slipped and finally admitted he had his "people" take the items out. We never recovered them.

And I see three properties he owns on Union St.

Guess what, he has NOT paid the school taxes this year's first payment nor the three years previous to that.  

So, when are the city dems going to publish the list of tax foreclosures?   This one should have lost all his properties 30 years ago.

And the craters, the only way you can collect any damages to your car is if you notified the city in writing prior to hitting that crater

I am sure Popolizio didn't have any insurance.  How funny would it be if he paid her cash for her injuries and then didn't pay his taxes.....

I'm sure as well.

Perhaps the city needs to mandate, as part of the rental certificate requirement, that the property owner provide a copy of the insurance binder on an annual basis.
