Dear fellow Rotterdamians:
Despite our best efforts, the brush tax was passed over Rick Larmour's and my objection. For all of you that want to opt out (like me) and also want to make a protest statement out of it (like me again), come to town hall on March 12th or March 26th. I will be notarizing opt out forms from my town board seat for a half hour before and a half hour after the conclusion of the regularly scheduled 7 PM meeting. Get your opt out form signed right on the same bench from which Buffardi, Calder and Viscusi shoved it down your throat.
For those of you that cannot make any of those times, I will make myself available on request at an agreed upon time. Please e-mail me at jvillano@rotterdamny.org.
Please make sure to bring your form and photo ID.

where do you get these opt out forms? some of my family members got theirs in the mail and some didn't. do they have to go to town hall and get these forms? thanks |

They are being mailed out now. Some people received their on Friday. I got mine on Monday. I'm not sure in what order they are being sent out. |

Joe There is no way you a town employee can notarize this form
You are a town employee
The town clerk won't process forms motorized by town employees
Or maybe my form wast good enough for just any notary to sign I needed an appointed notary |

I am not aware of any prohibition preventing me from notarizing anything. Your argument is circular exit3. You indicate that no town employee can notarize the form, except the clerk. The clerk is an employee of the town and also an elected official like me. The difference between other employees and the elected officials is that I have no supervisor over me except the tax payers. There is no one telling me not to do things as a courtesy for you. Furthermore, a notary is a state office. The town cannot unilateral restrict my powers which the state has granted me. If you are aware of a statute or state code, rule, or regulation that is contrary to my position, I'm all ears. I'm not infallible, I make mistakes like anyone else. I'm always interested in learning more about my conflicting responsibilities. |

Joe you are correct Here is the reply from the department of state on the issue of notary restriction "Notary Public's are Public Officer's acting on behalf of the People > of the State, not their employer. Notary Publics' and are required to > officiate upon request unless circumstances warrant a refusal such as > failure of the affiant to adequately prove their identity, reasonable > questions regarding the affiant's state of mind/competency, conflict of > interest, reasonable suspicions that notarizing the document will > perpetuate a fraud, etc." I am passing on to you and others that her highness the town clerk is restricting town employees who are notaries including yourself that only she her highness can notarize these special opt out forms In simple terms Who the Fu(k is running town hall The town board Or The town clerk |
