Rotterdam police allegedly broke the arm of an emotionally disturbed 16-year-old boy after two cops tried to remove him by force from a school bus he refused to leave, and a video revealed the cracking sound of a bone followed by the teenager's moans and shouted expletives.

Now an attorney representing the teenager's family is suing the town and seeking damages in excess of $1 million for a fractured humerus, possible nerve damage, medical expenses and pain and suffering.

The attorney said the teenager's medications were being adjusted at the time, limiting his ability to move. He has been diagnosed with multiple emotional disorders, including Tourette syndrome, anxiety disorder, bipolar disorder and pervasive developmental disorder, according to the family's lawyer.

The incident unfolded on the morning of Oct. 9, 2013 in the driveway of the teenager's Rotterdam home and came to light late Friday in a news release issued by Rotterdam Police Chief James Hamilton who said a review determined that "officers followed department protocol and procedures."


"They placed his arm in a position where they locked the arm and proceeded with significant force to break the arm between the shoulder blade and elbow, creating a displaced fracture."

Luibrand released an X-ray of the teenager's left arm that showed a gruesome break and a shattered bone midway up the bicep.

Ryan apparently was trying to handcuff Gocheski as he pulled and twisted the teenager's left arm at an awkward angle until a cracking sound of bone could be heard on the video.

That looked like he broke it on purpose   2 full grown officers can't even get a 16 year old kid off the bus without breaking his arm, put the kid in a full nelson and carry him off for Christ sakes. Now even more tax payers money out the fckn door because of these idiots and it will be a 7 digit payout.

There was an ambulance outside the bus - they told him they were taking him to the hospital ... this was NOT necessary.  The kid was disturbed and ill.

They DESERVE the payout they'll be receiving, and more.

Something else I just noticed ... watch the second video.  

The officer has a radio and other items in his utility belt, and leans forward toward "Jacob" - exposing all in his belt to another student sitting behind Jacob.

A weapon is clearly visible on the officers RIGHT side - directly next to an empty seat, and the bus monitor - again, unmonitored by the officer.

This is protocol?

and, why aren't the parents involved???....if he was in his driveway....seems to me that the better option would be to have a

parent calm him.....OR, if there was an ambulance there.....why were the police the choice to remove him.

this is what is wrong with this country....mentally ill or challenged are treated like criminals...no compassion.....no smarts...

hope all will be good with this boy again.....prayers to him and his family.....

In the second video, the officers are talking to the mother, who clearly says "she's never seen him this defiant" and she wants them to take him to the hospital.

I'm sure this kid has been on psychotropic meds his entire life, his idiot mother lets the psychiatrists do the parenting, as she stands back and plays the "woe is me" card to get sympathy. Her husband probably came to his senses years ago and left her, since she's probably medicated as well. It's sad that 'parenting' has taken on this form.

Regardless, they should sue. If cops don't know how to properly restrain someone, they aren't cops. The force with which his arm broke very well could cause permanent injury.

Another case why you should never call the police when trying to get help for someone with mental issues, it never ends good. After watching the video over and over the cop intentionally broke his arm, there is no doubt in my mind the cop knew what he was doing and what he expected to happen. If force was needed to remove him there was enough time to talk about how they were going to do it, the kid was obviously going nowhere.

OMG     OMG     What the cops SHOULD have done was called the CDPC crisis unit. This kid has Tourettes and associated disorders, MY son has
Tourettes and associated disorders.  For those who don't understand this it is VERY hard for kids with Tourettes during the school day. Many try and
"hold in" their tics, and at the end of the day they "let it all out" at home.

I never allowed medication for my son, but if this boy is on meds could be he was having some side effects, he looked out of it, like he was worn out.

I too feel sick to my stomach  

If you put your own arm behind your back it only goes so far, you can feel the muscles tightening etc. The cop bastar* pulled this kids arm up where it
never should have gone.

I heard that crack and felt faint.
