A member of a Minutemen militia was arrested Saturday night for allegedly pointing his AR-15 semi-automatic rifle at a Maricopa County sheriff’s deputy.
Richard Malley, 49, and two other group members were patrolling the area along Interstate 8 in search of illegal activity when two deputies approached, according to court documents. The Minutemen watch for unauthorized immigrants and drug smugglers crossing to Arizona from Mexico.
Malley pointed his rifle and flashlight at one of the deputies. He was also armed with a .45 caliber pistol and a fixed-blade knife. The deputy identified himself as a law enforcement officer, but Malley did not lower his weapon. Instead, he demanded that the deputy provide him with identification.
The deputy showed Malley his Maricopa County Sheriff uniform, including his badge, the patches on his sleeves and the word “Sheriff” across his chest. He then asked Malley to lay down his weapons, but Malley refused.
Malley was taken into custody once more deputies arrived. He said he thought the deputy was a drug smuggler and was in fear for his life.
“He’s lucky he’s still alive and he’s lucky my deputy is still alive. It could have been a very serious confrontation in the darkness at 9:30 at night,” Maricopa County Sheriff Joe Arpaio told Fox 10. “Somebody is gonna get killed one of these days over this situation.”

Tennessee father and son dead after AR-15 "goes off" and ammunition-filled room explodes

Officials in Tennessee say that a father and his 12-year-old son died over the weekend died after an AR-15 assault-style rifle accidentally discharged, causing a fire and then a series of explosions in a room full of ammunition.

A 5-year-old kindergartener has reportedly been detained at a school in Tennessee after a handgun discharged in the cafeteria.
Shawn Pachucki with Shelby County Schools told WMCT that police were called to Westside Elementary School following a gunshot that happened in the cafeteria at around 7:30 a.m. Pachucki said that the child brought the gun to school in a backpack and it accidentally discharged.
“This morning at Westside Elementary School, a Kindergarten student brought a firearm to school in his backpack,” a statement from Shelby County Schools said. “While waiting for the opening bell in the cafeteria, the firearm discharged accidentally inside the child’s backpack. Nobody was injured, and staff immediately took possession of the backpack.”
The statement added: “SCS Security and the Memphis Police Department responded quickly, and the matter is now under investigation. There is no evidence at this time of harmful intent; however, weapons of any kind are prohibited on campuses, and this student will be disciplined in accordance with the state’s zero tolerance policy.”

Lawyers for a Florida man this week cited President George W. Bush’s pre-emptive war in Iraq and the “Bush Doctrine” as a defense after their client killed two neighbors and attempted to kill a third on Labor Day.
Florida Today reported on Wednesday that attorney’s for William T. Woodward had filed a motion asking for charges against him to be dismissed under Florida’s Stand Your Ground law, which says that gun owners do not have a duty to retreat in the face of an “imminent” threat.
According to officials in Titusville, Woodward had snuck up on his neighbors while they were having a Labor Day barbecue. Police responding to the scene found that Gary Lee Hembree, Roger Picior and Bruce Timothy had all been shot.
Hembree and Picior were later pronounced dead. Blake survived, even though he had been hit 11 times.
In their motion, Woodward’s attorneys claimed that the victims had called him names and threatened to “get him.”
The motion referenced Enoch V. State, which suggests that an “imminent” threat can include something that is likely to occur at sometime in the future.
“I think legally that term has sort of been evolving especially given changes of our government’s definition of ‘imminent,’” attorney Robert Berry, who is representing Woodward, told Florida Today. “It’s become more expansive than someone putting a gun right to your head. It’s things that could become, you know, an immediate threat.”
The court document filed by the defense also cited “The Bush Doctrine,” a foreign policy principle used by President George W. Bush to justify the invasion of Iraq. “The Bush Doctrine” embraces “preventive” or pre-emptive war.
