It is likely that the billboard is grandfathered in because it was there well before 1998 when the legislation that you cite was passed.

Highly doubtful.   Learn to read; the legislation he cites does NOT have provision for being grandfathered in because existing prior to a date.

How about  only need read the words in bold below:




§ 270-151 Signs.


A. Applicability. No signs, whether new or existing, shall hereafter be erected or altered except in conformance with the provisions of this chapter. Nonconforming signs existing prior to the effective date of this section shall be permitted to remain; however, any change of use or sign shall conform to the requirements of this section.

B. Exceptions. For the purposes of this section, the term "sign" does not include signs erected and maintained in connection with the discharge of any governmental function, nor does it include political signs. Political signs are subject to the provisions of § 270-151.1 of this chapter. Billboards, that is any sign that directs attention to an idea, product, business activity, service or entertainment which is conducted, sold or offered elsewhere than upon the lot or parcel on which such sign is located, and is not a directional sign as defined herein, shall conform to the requirements of § 270-152 of this chapter.



§ 270-152  Billboards.

[Amended 9-9-1998 by L.L. No. 14-1998]

A. Definition. A "billboard" is any sign that directs attention to an idea, product, business, activity, service or entertainment that is conducted, sold or offered elsewhere than upon the lot or parcel on which such sign is located, and is not a directional sign as defined in § 270-151.

B. Billboards of any nature or kind are hereby prohibited in the Town of Rotterdam and shall not be permitted.

I understand that someone wants to debate what it means for a "non-conforming use" to be grandfathered in.  The fact is that the billboard (framework, etc) is what is grandfathered in -- and can remain in use.  The graphics can change as that is what a billboard is used for.  If the owner of the billboard wanted to take down the existing framework and build a NEW framework or substantially alter the framework -- that would NOT be allowed.  As long as the old billboard framework doesn't get blown down by a storm or collapse in an ice storm, it is a perfectly legal "non-conforming use" for as long as it remains standing and in use as a billboard.

Based on the wording, the "billboard" does not seem to be ruled by by 270-151, but rather exclusively by 270-152.  152 does NOT state any exception for anything existing prior.  

That's how I read it.


But there is another point to bring up.  Carman Rd/Hamburg St is STATE route 146.   Curry Rd is STATE route 7.   What are the rules of the state governing signs?

The usual babble response when he has can't carry on an intelligent "conversation" because he can't understand what a code or law is saying, or perhaps that he lacks the intelligence to know that there is more to the sign issue than town code since DV FAILED to mention that those are STATE roads and STATE laws may also apply.

It really isn't "news", they have been working on the site for a week and a half, and are already putting the foundation in.  The building should be completed by the end of the year.
