I just get a kick out of your statement that "the taxpayer" should recoup their money and consider it a "freebie" if it isn't recouped. As if the Medicaid recipient isn't or never was a taxpayer that paid into the system to receive the benefit.
Don't you think that if they have an estate that the money should be used to pay back what the taxpayers paid for their medical coverage? Or are you saying it should be a freebie???
If person works from age 18 to 55 and pay taxes into the medicaid system the entire time, then suddenly gets ill and loses their job - how much did that person pay INTO the medicaid system, and is that number figured in before the government "recoups" the taxpayer money? |

If they saved enough money to even have an estate, what happened to all the money they paid in taxes over that time to pay for the "safety net"? What is the point of paying into the safety net that was supposedly to protect your health and prevent you from going broke, if you are just going to go broke anyways? Isn't the government double dipping? What you are saying is, once you sign up for Medicaid, everything you ever worked for belongs to the government.
I guess the solution is, if you know you are going onto Medicaid...RUN AS MUCH DEBT AS YOU POSSIBLY CAN AND CREATE AN NEGATIVE ESTATE!
Not really -anyone with an 'estate ' has a good lawyer- not from anywhere around here set up an Asset Protection Trust . |

Not sure an asset protection trust would help in the case of Medicaid benefits. My understanding is that it works only for taxation, divorce and bankruptcy. |

Yah, went thru that with parent...not easy process. I think if I recall, they have a 7 year look-back. |

I just spoke to a young lady today, she looked through the choices available in NY and she can't afford them. She's not one of the lottery winners who get to freeload and gloat about it. She will probably be one of the uninsured. This is a real person, not an article in the paper. |
