Judge Halts New York City Soda Ban

A state judge on Monday stopped Mayor Michael Bloomberg's administration from banning New York City restaurants and other venues from selling large sugary drinks, a major defeat for the mayor who has made public a health initiatives a cornerstone of his tenure at City Hall.

The city is "enjoined and permanently restrained from implementing or enforcing the new regulations," New York Supreme Court Judge Milton Tingling decided Monday.

The regulations are "fraught with arbitrary and capricious consequences," the judge wrote. "The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole….the loopholes in this rule effectively defeat the state purpose of the rule."http://online.wsj.com/article/SB10001424127887323826704578354543929974394.html

The best way to make a government useless is to not obey them or their rules, NYC should tell Bloomberg to go to hell and continue to sell what they want with or without a judges ruling.

Still, I wonder how much money was lost from it, because most vendors probably didn't even order the large cups in anticipation.
It's an especially large problem for places like McDonald's, that have their names on the cups.

Plus Dunkin Donuts making you add your own sweetener. That's pretty handy when you drive thru.

It's just the idea of the state regulating your food.

Next they will make you weigh in at Price Chopper and your purchases will be allowed or denied based on your weight.

I'm going to go out on a very short limb, and say publicity.

Last week, nobody knew the guy's name. Today, he's in every newspaper, and news outlet in the country.
That kind of thing goes a long way when you're running for office.
Especially when you can say you "defiantly fought for the will of the people.

Keep this in mind...something I pointed out many years back. Price Chopper has a database of everything you buy with the advantage card and it wouldn't surprise me they already are using it with the food companies in some way.  Not unthinkable to someday have that database sent to health insurance companies.

I do very little shopping there first because they already are too expensive and because without using the card they gouge the $hit out of the shopper big time.

As far as the ban.  I can't believe the idiots that support the mayors plan to take away more freedoms from the people.  Hey, why doesn't he stop all vehicle traffic, trains and subways because they pollute the air and cause cancer.  What a jerk!

I wouldn't doubt it there is a few things companies want with your information, take how google uses your web history to market items linked to your history, also your history is now used to market items on your dvr box.
