SCHENECTADY — Mayor Gary McCarthy talked with Schenectady County Sheriff Dominic Dagostino about becoming city police chief even though state civil service law might preclude the appointment, according to individuals familiar with the situation.
By law, the successor to outgoing Police Chief Mark Chaires must be chosen from a certified civil service list because three assistant chiefs passed the police chief's exam in May. The measure states that a municipality with a population of more than 150,000 and four or more full-time members of the police department must have a chief.
The mayor, however, seems determined to circumvent the state civil service law because none of the three candidates — assistant chiefs Michael Seber, Brian Kilcullen and Patrick Leguire — lives in Schenectady. McCarthy has publicly said city residency is a prerequisite for the job.
As a result, he has been exploring alternative options and recently broached the idea to Dagostino, who lives in Rotterdam, during a phone conversation, said people with knowledge of the matter. The sheriff reportedly indicated to McCarthy he would only consider taking on the chief's position if he had the backing of the police and their union.
Before approaching Dagostino, McCarthy and other city leaders appeared to be leaning toward having Public Safety Commissioner Wayne Bennett, a Clifton Park resident who presides over the police and fire department, also take on the role as police chief.
The mayor did not return repeated calls seeking comment Thursday.
Last week, retired Schenectady police officer Robert Hamilton, who for years served as Police Benevolent Association president and currently works as the sheriff's chief deputy, met with the union leadership. It is unclear if Dagostino, who was elected sheriff in November 2009, could also be appointed police chief, a nonunion position. Neither he nor Hamilton could be reached for comment.
Chaires, who has served as chief since 2008, has confirmed he plans to retire before the end of the year to finish his doctorate in criminal justice at the University at Albany.
McCarthy has previously said he is looking at cost-saving measures and ways of streamlining the 143-member police department. Tapping Dagostino as police chief could be laying the groundwork for a merger of the two law enforcement agencies.
"You hear 'merger' but people love their community and the place they call home," said Mechanicville Police Chief Joseph Waldron, who also serves as president of the State Association of Chiefs of Police. "Bigger is not always better."
Asked about Dagostino possibly holding both positions, Waldron said, "I would say, absolutely no, because the sheriff has enough to do."

There are no "outsiders" in Schenectady County politics(*ehem* - I mean Law) enforcement.
Isn't Bob Hamilton Deputy Sheriff and head of the Road Patrol now? The same road patrol he opposed while acting as the Schenectady PBA President? They all have a price. I wouldn't be suprised if this deal is to make room for Hamilton as Sheriff.

SCHENECTADY — A city cop and former police union president is leaving the force after 21 years to join the county sheriff's office as chief deputy.
Lt. Robert Hamilton will assume his new leadership role on Jan. 16, eight days after he retires from the Schenectady Police Department.
"I like all the positive developments and thought it would be a nice career change," said Hamilton, 41, who also is president of the local Conservative Party club.
not cost effective...............you would need to retrofit a police vehicle with heavy duty springs and reconfigure the interior to account for his girth...........the interior of the HQ would also need to be attended to...............move the chiefs office to the basement to prevent the floors from failing from the added weight

As for the subject of the thread -- ignoring that the pathological liar known as the "Cowardly Cuckoo Who Can't Decide Whether He Is a She or She is a He" is making unfounded accusations ( i.e. that the mayor violated the law -- which the mayor has not) and can go rot in hell for all I care ---I think consolidating the police agencies in the county would be a good thing -- and if anyone is qualified to serve as the chief law enforcement agent it would Dominic Dagostino -- who is a great man and a great sheriff.
