I am wondering if anyone can tell me if there are any codes regarding where a dumpster can be placed on ones property.  The reason why I am asking is because I am a neighbor of a building who has recently relocated their dumpster right next to the property line.  It has been extremely difficult lately to enjoy my yard/deck without smelling the foul oders coming from the dumpster on the other side of the fence.  I have found codes regarding what can and can not be placed in a dumpster, when they can and can not be emptied, and all sorts of other silly codes, but I have not found anything that pertains to placement.  I have tried to reach out to the land owner where the dumpster resides via phone call, and I have not heard a word back.  Can someone point in the right direction? or am I SOL?

just get a bag of manure...place it in the dumpster when folks are at said residence and light it on fire....

of course leave an extinguisher nearby, so as to be a good neighbor.....

Well, this particular property owner is a "friend" of the town and seems to be able to do whatever he wants.  I am sure if I walked in there, they wouldn't even bother to look it up and they would say it is "ok"

it can be done by you

not town hall but coutry office bldg on nott and albany streets

if you have the sbl or swiss have the clerks staff look up the book and page - show you where it is a and you can do the rest

Best I could find...might help a little. But honestly, if person is FRIEND OF LA FAMIGLIA, then even if they are illegal, likely nothing would happen except bad blood with you.

§ 265-9. Littering; appliances; receptacles.




A. All properties, whether improved or vacant, shall be maintained free of litter; provided, however, that this chapter shall not prohibit the storage of litter in authorized private receptacles for collection.

B. Adequate sanitary facilities and methods shall be used for the collection, storage, handling and disposal of garbage and refuse in accordance with the provisions of applicable codes. Editor's Note: See Ch. 244, Solid Waste.

C. No appliance may be discarded, abandoned or stored outdoors in any manner without first completely removing any locking devices and all doors.

D. Dumpsters and similar large receptacles shall be screened from public streets, rights-of-way, and areas where pedestrians frequently travel. Said screening shall consist of a solid row of evergreens, or solid fencing to hide the dumpster/receptacle from public view.

E. Shopping centers, supermarkets and similar business units shall provide permanent and sanitary litter receptacles within the interior of the premises for public use in sufficient quantity to prevent a person from walking in excess of 100 feet to use any such receptacle. Receptacles shall be of sufficient size to accommodate small items of patron's trash (i.e., shopping lists, tissues, gum wrappers, etc.).

You should call code enforcement to report the problem.  Also, placement of any dumpster(s) would be indicated on the site plan when it was approved.  

And I believe it is highly inappropriate to call the town lazy or to otherwise disparage it when one apparently hasn't actually notified the town of the problem.  The town employees are very hardworking, take their responsibilities very seriously and do (IMHO) an extremely fine job of carrying out their duties.

Okay, maybe i missed this.....but is this a business or residential? Cause I can't see a residential property owner having a dumpster on their property unless they are doing major construction. If it is a business...there are codes.

And whether someone is in the 'friends and family club' or not.....it appears that ya gotta give 'the powers that be' a chance to rectify it if it is in fact illegal. If they don't....then call the 'state health dept.'

the reason to check the deed is the property owner prior or the developer may have put location limits for "waste storage" before the finished project was transfered to the final owner

this was common practice when the town had an engineer working in  the interests on the taxpayers
