States could dodge a key part of the health care reform law because of a little-noticed mistake in the lengthy bill, according to a white paper by conservative health care experts Michael Cannon and Jonathan Adler.
A missing word in the law's definition of a health insurance exchange could prevent the federal government from doling out crucial subsidies to aid middle class and lower-income people in buying insurance in states that refuse to set up their own exchanges. (Only 14 states are close to setting up exchanges so far. The federal government will set up back-up exchanges in states that don't have their own by 2014.) If Cannon and Adler are right, the federal government would also not be able to fine large employers in states without exchanges if their lack of coverage leads employees to buy insurance in a federal exchange. The law defines a health insurance exchange as a "governmental agency or nonprofit entity that is established by a state" in one section of the law, and then says later that individuals who participate in exchanges under that definition are eligible for subsidies. Because the law only says a "state" and not "a state or the federal government," Cannon and Adler argue that the federal government cannot legally dole out subsidies or tax breaks to people who buy insurance from federal exchanges.
The Obama administration has said that the intention of the law is clear, and that they fully plan on handing out subsidies when they set up federal exchanges in states that do not set up their own. (Other legal experts agree. Tim Jost, a law professor at William and Lee University, told Yahoo News the pair's thesis is "wishful thinking.") But Cannon and Adler argue the "mistake" was an intentional choice to push states to set up exchanges, and that the administration must deal with the consequences. If the law's opponents sue over the missing language and win (both big hypotheticals), it would mean considerably fewer people will gain health insurance under the law than was planned--because the lack of subsidies means those without insurance would not be forced to purchase coverage. Obamacare — the majority of folks don’t like it, or want it, as their health care system. As it is socialized medicine, pure and simple. It doesn’t work for the benefi t of the citizens of Canada/western Europe. We have the best doctors and hospitals in the world; folks who can afford it, come here from everywhere for treatment. True, it’s not perfect and it sorely needs some drastic changes. Sadly for us, we are represented by folks more interested in representing themselves than those they claim to represent. They know full well that tort reform, competition of insurance companies across state lines, special measures to address those whom fall between the cracks and the punitive punishment of those who now cheat the system — will maintain our best care in the world. Obamacare is a cop-out. Sure, it has some come-ons and the sugar coating tastes good. As in; “Look! Vote for me — I got you more free stuff.” That is until one takes it upon themselves to take an honest look at the wait lines, denials of care, bureaucratic regulations and runarounds the folks in Canada and Europe deal with on a daily basis. If one has any doubts about their senators or representatives in Congress representing themselves [look what they did in conflict with the 28th Amendment]. They passed “Obamacare” for you; but kept the “Cadillac” [health care] plan for themselves.
I don’t think there’s much question the biggest lie that’s been widely told about the Affordable Care Act is the McCaughey/Bachmann/Palin “death panel” meme. I mean, it’s just a total fabrication.
And the second biggest lie is probably the “government takeover of health care” bit.
But number three is likely the claim, asserted against all the available evidence, that “ObamaCare” will involve a monstrous expansion of the federal budget deficit. So today’s news via Jonathan Cohn is worth repeating and emphasizing:

The estimate largely tells us what we already knew: The law, when fully implemented, will dramatically reduce the number of Americans without health insurance. It will also reduce the deficit. This last part remains a big deal, if only because so many conservatives—and, yes, so many members of the public—refuse to believe it. Over and over again, you hear people saying that Obamacare will run up the deficit. The CBO, which is our most reliable guide on such matters, begs to differ….

In March 2010 leading democrats and their lackeys in the state-run media were “just giddy” to report that they crunched some numbers and found the nationalized health care bill they were pushing would reduce the deficit by $138 billion. It was a lie. Democrats knew it was a lie… But, after several backroom deals they rammed the bill through Congress anyway.
Then in May of 2010 the CBO corrected the numbers and said Obamacare will cost taxpayers at least $115 billion more than promised. Democrats pulled a fast one on the American public. Republican Senators pointed out the deceit in a 2010 video:
Democrats promised that Obamacare would cost $940 billion when they rammed it through Congress. The actual cost has gone up with each revision.
