Dairy, city find a way out of whey dispute
F. Cappiello churns out check for $220,000 to pay outstanding debt

SCHENECTADY — A check presentation from F. Cappiello Dairy to the City Council on Tuesday night gave cash-strapped Schenectady $220,000 from one of its homegrown businesses.

It also ended a 20-year legal dispute in which Cappiello had owed the city for discharging too much whey — the liquid by-product from making cheese — into the city's sewer system.

Cappiello, whose Broadway factory produces Italian cheeses sold by retailers such as Trader Joe's, Wegmans, Whole Foods and Price Chopper, was purchased by Wisconsin cheese producer BelGioioso Cheese Inc. in November, and the company wanted to pay what Cappiello owed from the legal wrangling that dated back to 1991.

But the issue arose again during Mayor Brian U. Stratton's tenure from 2003 to 2011, when city officials said Cappiello had to make good on the entire bill. The dairy company sued, but a settlement in 2010 required Cappiello to pay another $250,000, in addition to what had already been paid.

At that time, Cappiello was looking for investors to sink more than $3 million into factory improvements to grow the company's profits.

But Peter Cappiello said it was more advantageous to sell, citing his company's dispute with city officials as what ultimately pushed him out the door.


Seems like Cappiello was not a member of the Dem Friends and Family club, huh?     Stratton gives taxpayer money out left and right to millonaires, but a long time business he screws them over.   Not saying they should be tax exempt, but Rudnicks has been downtown for, what, 75 years or so, are they getting being rewarded with tax breaks for hanging in there through thick and thin and probably struggling to pay their own taxes PLUS the taxes of the properties that surround them?    Just like the homeowners, what did, what do the dems do for the financially struggling homeowners, NOTHING, ABSOLUTELY NOTHIING, it's "pay up or lose your house."   The dems dictate to the homeowners:   Pay your taxes on your $30,000 income, AND pay the property taxes of the millionaires downtown, if you don't pay the taxes of the downtown millionaires and poliically connected, then you lose your home - SCREW YOU"

Better to have open eyes, see the truths, acknowledge the negatives, and
speak up for the people rather than the politicos and their rich cronies.

No, the city treated them with contempt just the way it treats any of its long time established businesses who pay the the full tax load and employ people, but who DON'T SUCKHOLE FOR THE DEMOCRAP CRIMINALS. The city goes out and harasses and violates the small business people's civil rights, targets them, threatens them, treats them with a heavy hand and utterly abuses them.
