Notre Dame sues Obama administration over birth control mandate

On Monday, the University of Notre Dame filed suit against the Obama administration over its rule that all employers must offer contraception in their insurance plans. Notre Dame is now the seventh religious college to sue over the mandate; it's also the largest school to do so.

President Barack Obama gave the commencement address at the prominent Catholic university in 2009.

In its suit, the school says that health care reform's contraception mandate violates its religious freedom and would require it to go against Catholic principles by offering contraception and sterilization to students and faculty in its insurance plan. Don't know if it was a Freudian slip by the Admin, but I like your title on this better than the one that the original editors came up with, after all, it is a war on Women and their rights to be mothers and follow their religious beliefs, right?  "Notre Dames," not "Notre Dame."

Senior administration officials announced early this morning that President Obama will announce a new
“accommodation” for religious liberties in the rule requiring all employers to offer contraception coverage
without additional cost sharing. Under the new policy, “all women will still have access to free preventive
care, including contraception,” no matter where they work. However, if a nonprofit religiously affiliated
organization like a Catholic college or hospital objects to offering birth control, the insurance company will
be required to provide the coverage free of charge and the employer will not pay for it.

The mandate is modeled on existing rules in six states, exempts houses of worship and other religious
nonprofits that primarily employ and serve people of faith, and offers employers a transitional period
of one year to determine how best to comply with the rule.
It’s also nothing new. Twenty-eight states already require organizations that offer prescription
insurance to cover contraception and since 98 percent of Catholic women use birth control, many
Catholic institutions offer the benefit to their employees. For instance, a Georgetown University
spokesperson said yesterday that employees “have access to health insurance
plans offered and designed by national providers to a national pool. These plans include coverage
for birth control.”

So, in other words, he's going to make the company that they work for cover it, they're just not going to make them pay for it.  They're going to make the insurance company give it to them for "free," but they won't get a reduced price on the premiums that other companies that don't care whether it's in the plan or not (or actually wanted it in the plan).  So, in fact, in name only, they will "not be paying for it."  

The employees will get it "free," the company "won't pay for it," but the insurance company will not reduce their price.  In other words, we'll tell you you're not paying for it, even though you still have to actually pay for it.

It's so funny, the article acknowleges that many Catholic organizations offer plans that include birth control.  That's how we know this has nothing to do with women and womens reproductive rights, but rather CONTROL over the Catholic and other religious organizations.  The government doesn't want voluntary participation BUT MANDATED compliance.

OK.  This has been posted several times, but for those who may have missed it...

IT'S CHEAPER TO OFFER BIRTH CONTROL FOR A GROUP THAN NOT TO.  WHEN YOU OFFER BIRTH CONTROL,
WOMEN USE IT AND GET PREGNANT MUCH LESS OFTEN PER GROUP THAN WHEN IT'S NOT OFFERED.  AN
INSURANCE COMPANY SAVES DOLLARS IF THEY OFFER BIRTH CONTROL BY NOT PAYING FOR THE VERY
EXPENSIVE ENSUING PREGNANCY AND BIRTH COVERAGE.

The options are:
Pay for relatively inexpensive contraceptive coverage,
or
Pay for pregnancy, prenatal, hospital birth, recovery, and add a new dependent baby for the next 18 years.

Birth control is a bargain for the insurance company.

The future productivity of a new born baby pays into the future risk pool.  If you limit the birth rate, you shrink the future risk pool, which actually increases cost for the users in the system.

The population of the USA and the entire earth is growing, not shrinking.  Insurance companies, like most
US corporations rely on this year's profit... often this quarters profit... not the long range birth rate of the
entire USA.

Since prenatal, and birth coverage is pretty much universal, the insurance companies can't deny that coverage.
What they can do to lower their costs is to promote a customer base that is healthier longer and has
less medical needs for a longer period of time.  Since they can't easily eliminate pregnancy, hospital and
child coverage, one way that impacts their bottom line directly is to offer an easy, inexpensive contraceptive
coverage to lower their costs.
Don't worry about babies being born Cic... The Human race has been spitting out babies for hundreds of
thousands of years... A conservative War on Women is doomed to failure.

That is a new requirement by the Obama administration to require employers provide insurance coverage for contraceptives. Religious institutions would have to meet several criteria to be found exempt.

It's a sensitive subject for Catholic institutions, so the Archdiocese of New York filed a federal lawsuit in Brooklyn on Monday. So the birth rate goes up regardless of "free" contraception?  How is insurance companies giving "free" contraception paying for itself again?  You tend to talk in circles and double speak. Will the insurance companies recoup the cost of the "free" contraception given away this year through increased premiums next year?  It isn't "free" but a delayed cost.

I don't understand the premise of "free contraception" pays for itself if the overall population goes up regardless.  Your argument used to based on the cost saving from reduction of children born paid for the birth control.   Now you argue that it doesn't affect the birth rate.

Only you can can give evidence arguing against your own premise and think you are advancing your argument.

If there is such a population explosion because of 'lack of' birthcontrol, I'd say the rest of the groups should step up to the plate and STOP taking
flu shots.

First, I challenge the statement that 98% of Catholic women use birth control.  Common sense will tell anyone that Catholic women who have not reached child-bearing age and those who have passed child-bearing age are not likely to be using birth control.  

Second, it doesn't matter how many individual Catholics ( or of any church for that matter) follow a church teaching or not.   The Constitution clearly states "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..." .  We are reminded of Thomas Jefferson's own words in the  Virginia Statute for Religious Freedom, written in 1779: "No man shall be compelled to frequent or support any religious worship, place, or ministry whatsoever, nor shall be enforced, restrained, molested, or burthened in his body or goods, nor shall otherwise suffer, on account of his religious opinions or belief; but that all men shall be free to profess, and by argument to maintain, their opinions in matters of religion, and that the same shall in no way diminish, enlarge, or affect their civil capacities."

For me, the most important issue in the 2012 Election is whether our FOUNDATIONAL NATIONAL PRINCIPLES of Religious Liberty/Freedom of Expression will survive.  I can not and will not support a candidate for president who not only has no respect for Religious Liberty but has plainly and clearly declared war on it.
