I guess the President didn't learn in school or college that the Supreme Courts job is to decide if the laws passed by the not so bright sometimes legislature are Constitutional or not.
Judges order Justice Department to clarify Obama remarks on health law case Published April 03, 2012 | FoxNews.com
A federal appeals court is striking back after President Obama cautioned the Supreme Court against overturning the health care overhaul and warned that such an act would be "unprecedented." President Obama Locks Horns With Chief Justice Roberts Over Health Care Case Posted: 04/ 4/2012 8:05 pm
WASHINGTON -- Looking to a Supreme Court decision in the health care case months away, President Barack Obama has locked horns with Chief Justice John Roberts over how historically significant a decision striking down the mandate would be.
"We have not seen a Court overturn a law that was passed by Congress on a economic issue, like health care, that I think most people would clearly consider commerce -- a law like that has not been overturned at least since Lochner," Obama told reporters on Tuesday, defending his Affordable Care Act in the face of news stories predicting a loss at the high court. "So we're going back to the '30s, pre-New Deal."....................>>>>......................>>>>..................http://www.huffingtonpost.com/.....chner_n_1404256.html
An appeals court judge who claimed President Barack Obama was challenging the authority of federal courts was just throwing a “judicial hissy-fit,” according to legal analyst Jeffrey Toobin.
“Totally extraordinary and totally inappropriate,” Toobin said.
U.S. 5th Circuit Court of Appeals Judge Jerry Smith on Tuesday demanded a “three page, single spaced” letter from the Justice Department regarding the authority of the federal courts to strike down laws passed by Congress. Obama said Monday that the “unelected” Supreme Court should not to take the “extraordinary” and “unprecedented” step of striking down the Affordable Care Act.
“What the President said was entirely appropriate, entirely within his rights as an American citizen to express his opinions about this law,” Toobin continued. “He wasn’t intimidating the Supreme Court. He couldn’t intimidate the Supreme Court if he wanted to. He was simply saying that he believes this law is constitutional, and this judge, doing this ridiculous patronizing act to the Department of Justice has simply made himself look ridiculous.”
