The place: The Gore Mountain ski resort in North Creek.

The scenario: A 17-year-old snow boarder slides down the mountain. He misjudges the path of a skier beneath him. The snow boarder and skier collide.

And who did Andrew Nicoll, the snow boarder, hit that day? Saratoga Springs City Court Judge Jeffrey Wait, a recently declared state Supreme Court candidate for the Fourth Judicial District.

So hundreds of people on a mountain, and Nicoll runs into an experienced member of the legal profession. What luck!

The accident made Wait very unhappy, to put it mildly. The 52-year-old judge says he lost his cool, angrily confronting Nicoll and demanding that the resort’s ski patrol reprimand the teenager and initiate an accident report.

“The kid learned a whole new vocabulary,” Wait says now. “I was so freakin’ angry.” (more…)

It amazes me someone who thinks they are worthy of being a NYS Supreme Court justice would bother suing someone in his district during an election year. He basically describes himself in the article as vindictive and hot headed. I can't imagine the Dems, or anyone, are going to run this guy in November.

His whole attitude of 'well, it's OK b/c I'm just suing the insurance company" is misguided at best. If the homeowner's carrier pays, his rates will go up, or worse, he'll be canceled. Every one of us pays b/c of guys like Jeff Wait. It was an accident; there was no malicious intent, which is generally the bar in cases like this. It was probably the kid's fault, but we don't know. Article 18 (NYS Ski Law) places responsibilities on the downhill skier as well. And as someone who skis at Gore ~30 days a year, I can tell you those 1st few weekends are treacherous at best. I don't bring my two kids there until mid-Dec when things improve, safety-wise. It's narrow and fast early; it doesn't mean the 17 year old was or wasn't negligent, but everyone assumes some level of risk.

It's also interesting that he didn't require any medical treatment at the scene. In fact, if you get ski patrol involved, you have to sign a waiver that you are releasing yourself (this protects the mtn). That he didn't realize til later he had a broken shoulder blade and torn rotator cuff....well, something there just doesn't seem right. I also hear reports of this guy being seen around town in December and showed no signs of any injury. Circumstantial and here say, for sure, but....well, you be the judge.

I used to snowboard. But I can't afford to take the risk to be injured anymore. Growing up I never liked skiing but my friends all did. Every one of them has had a collision and once, one of them smashed into the other and he ended up in the hospital. These were guys who skied a LOT too. I have another friend who fell and broke his collar bone avoiding someone. Skiing has been an activity, like race car driving, parachuting, scuba diving, diving off a high platform into the water, playing football and mountain climbing that is one of those "DO SO AT YOUR OWN RISK"  activities!!!!!!! Only democrap asswipes like this turd will ruin it so that all risk is made prohibitive.

Getting injured skiing happens, or you really never ski. If lawsuits are lodged over this then no one will ski, the slopes will close and/or the ticket prices will be even more astronomical then before. I only imagine that this scum of the earth politician democrap has special clout in the courts and this is already jury rigged for him.

He WILL be on the ballot in Rotterdam with his socialistic running mates this fall. Send them ALL a message telling them to (in the words of turd-smell boy Ron) GO F YOURSELF!

Lets see... where to begin?
If a ski resort fails to take action when a skier is skiing irresponsibly, they can be held liable for damages.  Any
skier skiing out of control should be reported to the ski patrol.  Any ski patrol member is authorized to take the
lift ticket of a skier skiing dangerously.  They often start with a warning, but if ignored, they take the lift ticket.
Probably the reason the injured skier in this piece reported the incident to Gore Mt ski patrol.

Now for your questions...
Q.Have you ever been to a ski resort,
Yes.  I skied Pico two weeks ago and at Gore on Tuesday.  I've only skied 6 or 7 times this year due to the
sucky weather.  I've been skiing for over 30 years.

Yes.  Probably fired more firearms than you've ever seen, and I don't know how many rounds I've fired but at
least in the thousands, maybe tens of thousands... I've never kept track.

Q. Rock Clime, SCUBA & hockey

Yes for years.

Not any more.

I do rollerblade, kayak, ski as often as I can as well as CC ski & showshoe.  I own a JetSki, row boat, and
occasionally target shoot.

Back to the issue at hand.  If a skier runs into another person on the slopes while skiing and was considered
to be skiing recklessly and out of control, the same rules apply as if you were at a shooting range and
were shot by a shooter who was acting recklessly and out of control.
Most accidents on the mountain were just that... accidents.
Accidents happen, but if the skier were skiing dangerously, and ran into someone, especially if it was obviously
reckless, and collaborated by unbiased witnesses... the lawsuit may be successful.

That is why I don't snowboard anymore. I can't afford to risk injury since I can't get on the teet, and if I do fall and hit into someone, I can't afford with some pus$y  suing me because he had a boo-boo and thought he was guaranteed to never get in an accident on the slopes. Typical lawyer scum. It is everything WRONG with America and why I can't live with the NY mentality anymore. The Long Island as_ hole mentality has pervaded everywhere. I would rather be dead than live like a slave.

So I imagine you are gonna tell me you never fell or made contact with anyone on a ski slope, or ALMOST caused an accident, because YOU are such a perfect skier... urfricking real.

IS DIRECTED TO A POSTING "WARNING TO SKIERS" WHICH IS DISPLAYED WHERE TICKETS LIKE THESE
ARE PURCHASED.  NEW YORK LAW REQUIRES YOU TO SEEK OUT, READ, REVIEW AND UNDERSTAND THAT

GENEVA (AP) - Canada and the action-sports world endured their second tragedy in two months Saturday with the death of skicross racer Nik Zoricic, who suffered head injuries after crashing into the nets on the side of the course near the final jump of a race in Switzerland.

Ski authorities called it a "freak accident," much the same way they labeled the fatal accident of Canadian freestyle skier Sarah Burke, who crashed during halfpipe training two months to the day before Zoricic's accident.

Both Burke and Zoricic were 29.

International Olympic Committee President Jacques Rogge called Zoricic's death "a very sad day for the whole Olympic Movement."
