FACT SHEET:  PROCEDURES IMPLEMENTING SECTION 1022 OF THE
NATIONAL DEFENSE AUTHORIZATION ACT FOR FISCAL YEAR 2012  


President Obama today issued a Presidential Policy Directive that sets forth procedures
implementing Section 1022 of the National Defense Authorization Act for Fiscal Year 2012
(NDAA).  These procedures, which are expressly required by the NDAA, are designed to ensure
that Section 1022 is implemented in a manner consistent with our national security, our laws, and
our values.

The procedures reflect the consensus of the President’s national security team that
maintaining the seamless integration of our law enforcement, military, and intelligence
professionals – and for the executive branch to determine how best to capture, detain,
interrogate, and try suspected terrorists – is essential to our success, including our ability to
collect intelligence and incapacitate dangerous individuals.   You can read the full document

The procedures include several important elements:

• The procedures provide greater clarity to our counterterrorism professionals by clarifying key
phrases in the statute and explaining that Section 1022’s military custody requirement applies
only to non-U.S. citizens who are closely linked to al-Qa’ida and have participated in
planning or carrying out an attack or attempted attack against the United States or our
coalition partners.  The procedures also make clear that existing Department of Defense
policies and procedures satisfy the requirements of Section 1022.  

NDAA Nullification Passes Virginia Senate by a Veto-Proof 39-1 Vote. Other states are planning to follow the same path to reject or nullify this bill as well, this is the only reason Obama is trying to cover his a$$ now, after all it was him who wanted these provisions in the bill in the first place. The best thing to do is to continue to have the states nullify this because the words are still in the bill which allows detainment of Americans by the military. What Obama did today is just lip service which he can be pulled at any time of his choosing.
