What have the dem leaders in this city done about Popolliziio?

What have the city dems done about taking Popolizio's money in order to pay back the taxpyaers for the cost of the demolition of that building that had the fire and Popolizio didn't carry insurance on.

Have the dems in the city investigated to find out whether he has insurance on any of his other buildings?

If the dems in this city were good leaders, they would make a law that ALL landlords were mandated to provide proof of insurance to the city faithfully every six months AND make the city a beneficiary of sorts, in other words, if a fire occurs and a building must be demolished, the insurnace company MUST make the check payable to the city instead of the property owner.

What's with the dems in the city, always looking the other way when it has to do with Popolizio, always letting him off the hook.


Optimists close their eyes and pretend problems are non existent.  
Better to have open eyes, see the truths, acknowledge the negatives, and
speak up for the people rather than the politicos and their rich cronies.

Landlord fined on new violations policy

    The city isn’t taking excuses any more.
    A landlord who has faced dozens of code violations at buildings spread across the city became to fi rst to fall afoul of the city’s new get-tough policy.
    Frank Popolizio pleaded guilty this week to minor code violations that he had fi xed prior to coming to court. In the past, fixing the violations — even at the last minute — would have been enough to satisfy the city.
    This time, city Assistant Corporation Counsel Carl Falotico asked for a fi ne. Popolizio was assessed $12,500, which Falotico said was the highest city fine court offi cials could ever remember for code violations.
    Falotico added that the violations were “nothing major.” Popolizio had rotted steps and peeling paint on a rental property at 1307 Nott St. The house also had a cracked foundation and he didn’t have rental certificates for the units.
    “Definitely not the worst case we’ve ever seen,” Falotico said. “But the thing is he’s a persistent offender.”
    Time after time, Falotico said, Popolizio would ignore violations until he was finally taken to court, months after the violations were fi rst cited.
    “He’ll never do it. He drags his feet and he’ll never do it until we drag him before a judge,” Falotico said.
    He hopes Popolizio’s fi ne serves as a warning to other landlords.
    “If you want to work with the city and fi x stuff, we’ll let you off real easy,” he said. “If you thumb your nose at the city, we’ll come down hard on you.”
    Popolizio declined comment. His attorney, Dennis Englert, said the fine was a “compromise.”
    “Mr. Popolizio was charged with rather minor defects in the property,” he said. “The fine is so high because the penalties for violating the city code are very high.”
    In the past, the city has had a gentler approach even with landlords who ignored major code violations.
    Dean Redman, whose rental building collapsed in 2007 with tenants still inside weeks after code enforcers said it was structurally unsafe, was not taken to court for code violations.
    Instead, Corporation Counsel L. John Van Norden asked for $19,000 to repay the city’s cost to demolish the half-fallen building. ..................>>>>....................>>>>...................http://www.dailygazette.net/De.....r01101&AppName=1

Amazing that the city dems did NOTHING for so many years.   Amazing that the dems have not even repaid the taxpayers for the cost of the demolitions at Pop's place that had the fire.   That $12,500 comes no where close to repaying the taxpayers.

Amazing the dems didn't do anythng until they saw the connection between animal abuse and people abuse

Ok...let's just look at the 'facts' here. Popolizo was fined $12,500, the highest code violation in schenectady history, for NOTHING MAJOR???? Are we to assume that this 'historical fine' was based on the fact that he was a 'repeat code offender'????

Did Mr. Popoizio pay code violations in the past.....or did the city just turn a blind eye??

It would appear, that Popolizio would have slid past this one too if it weren't for another county embarrassing schenectady for not upholding their laws 'historically'.........yes?

So this was a win-win for both popolizio (only $12,500) and the city for apparently being embarrassed into enforcing their code laws.

Another continuing saga. The DEMS never do anything but ignore issues and raise every tax and fee. Why should Pops be different?  Back in the news today. Big problem with his sales taxes at the Pentagon. Allegedly shorted the State around $75,000. Indicted in Schenectady City Court on charges of grand larceny/tax fraud. No word on the 49 counts of animal cruelty.

Popolizio arrested on sales tax charges

    A local property owner who has had his share of run-ins with municipalities over unpaid property taxes and code violations is facing a new tax dispute — and this one could potentially send him to prison.
    This dispute relates to more than $75,000 in sales tax the state says Frank Popolizio failed to pay from his now-closed Erie Boulevard restaurant, The Pentagon.
    Frank Popolizio, 66, of Morrow Avenue, Schenectady, was arrested Friday morning by the state Department of Taxation and Finance on a total of five felony charges: one count each of second- and third-degree grand larceny as well as two counts of third-degree and one count of fourth-degree criminal tax fraud. He also faces two counts of fi fth-degree criminal tax fraud, a misdemeanor.
    If convicted of the second-degree grand larceny count, Popolizio would face a maximum of five to 15 years in state prison, though he could get as little as probation.
    Popolizio appeared in Schenectady City Court on Friday afternoon with his attorney, Dennis Englert, and pleaded not guilty. Bail was set at $5,000. Popolizio posted the bail immediately and was released.
    Englert said later that the case stems from a 2 /2-year-old accounting battle that includes disagreements over how much is owed. The charges, he said, are the state’s way of putting pressure on Popolizio.
    “The sales tax people just chose to take this method,” Englert said. “We say we’re not guilty.”
    Popolizio could not be reached for comment.
    The charges all relate to sales tax the state says Popolizio owes from The Pentagon between January 2010 and February 2012.
    Popolizio is accused of failing to fi le timely sales tax returns with the state Department of Taxation and Finance for six different quarters.
    Then, in August, Popolizio fi led sales tax returns for the six quarters, reporting at least $75,000 in sales tax collections, none of which has been paid to the state, according to papers filed in court.
    Then, even after state investigators contacted Popolizio, according to the fi ling, he continued to fail to pay sales tax collected by the restaurant for the final two quarters it was in operation.
    “Failure to file and pay sales tax is a crime that we take very seriously,” state Department of Taxation and Finance spokesman Geoff Gloak said.
    When investigators contacted Popolizio, he placed responsibility for failing to pay the sales tax on his accountant, according to the papers filed in court. The accountant, though, told investigators that he was never hired to prepare or file sales tax returns but was responsible only for the filing of corporate income tax returns.
    The Pentagon tax debt is on top of another $85,000 in sales taxes owed from 2002 to 2008 at Popolizio’s dog kennel business, according to the state Department of Taxation and Finance. No charges have been fi led in that case.
    Friday’s arrest was the latest incident in what could be termed a bad year for Popolizio, in which he has also faced charges of animal cruelty, the closure of his Pentagon restaurant and the biggest fine for a city code violation in memory.
    In January, his dog business in Otsego County, South Side Dogs, was raided by state police. They seized more than two dozen dogs in what investigators claimed was an animal breeding facility with dozens of malnourished dogs. Popolizio and another woman were then charged with 49 total counts of animal cruelty.
    In February, The Pentagon shut down. Popolizio said then that he needed a break from the business.
    But he was also behind on other taxes, according to records. He was more than $31,000 in arrears in property taxes on the restaurant for 2010, 2011 and the first quarter of 2012.
    The property also has tax liens that date back to 2001, according to the city’s Tax Department. Those liens were sold to American Tax Funding, which was pushing to foreclose on the property until Popolizio declared Chapter 13 bankruptcy in July 2010.
    Popolizio owns nearly two dozen properties in Niskayuna, Schenectady, Scotia and Rotterdam. He has faced a number of problems in recent years, ranging from property maintenance issues to code violations.
    In December 2010, fire ripped through a rental property he owned on McClellan Street, killing a third-floor resident. The body of the man wasn’t found until the city began demolishing the burned-out structure nearly a month later because of a mix-up between Popolizio and fi re officials over who lived in the building.
    Then, in March, the city assessed a $12,500 fine against Popolizio after he pleaded guilty to minor code violations. Ask Obama. On top of the 49 counts of animal cruelty Pops now faces allegations of failing to pay $85,000 in State taxes on his Otsego County puppy mill. Separate from his Schenectady grand larceny/criminal tax fraud charges.

The amusing part is that the city has actually turned a blind eye for decades on this guy. The only reason that they are NOW going after this guy is because the state/city are BROKE!!! They are only NOW looking under ever rock for a buck!! This guy has been 'allowed' to as he pleased and when he pleased for years and years. Everybody knew it.........Nobody did nuthin'!

So now the same leaders that 'allowed' this guy to get away with everything......is now using him for their sacrificial lamb!

The FEDS jump on Popolizio immediately, yet the City of Schenectady let's him have a free-for-all for decades.

I've seen first hand some of his apartments - they weren't fit for a animal to live in.

Wonder how many times code enforcement was called and they failed to do anything for the Popolizio tenants. Like to get those records.

I'm sure DV can explain to us why his buddy dems have not gone after Popolizio.   DV should be able to explain to us why McC makes the homeowners pay for the cost of demo on that McClellan St bldg instead of hauling him into court for hundreds of thousands of collars.

But then, McC and his buddy dems made the homeowners in the city pay almost the highest taxes in the whole country in order to bestow a whopping quarter of a million dollars on Alsdorf and Todd for that Foster hotel building that they didn't put a dime into (for which the pair also caused over a million dollars in damage to also), and then the dems made the homeowners pay the delinquent taxes on the building AND the dems are making the taxpayers throughout the county pay for fixing up that building and then, after it's done, the dems will force the homeowners in the city to cover the property and school tax bills of that building after some wealthy owner has it.


Perhaps the dem DV can explain why the taxpayers are not being informed of the use of their money.
