SCHENECTADY — A state administrative law judge has revoked the driver's license of a city police officer charged with drunken driving last month in Bethlehem because he refused to take a blood-alcohol test after he crashed his car in Selkirk.
BETHLEHEM - William Fennell, a veteran Schenectady police sergeant, pleaded guilty to driving while intoxicated Tuesday in connection with a hit-and-run accident at the intersection of routes 9W and 396.
Fennell made the admission in Bethlehem town court. Fennell declined to talk to a reporter as he left court.
As part of his sentence, Fennell's license was revoked for six months. And for the next year, he'll have to use an ignition lock that will check whether he is under the influence of alcohol every time he turns over his vehicle.
Fennell was sentenced by town Justice Ryan Donovan.
Assistant District Attorney Renee Merges said prosecutors would not allow Fennell to plead guilty a lesser charge.
"This is the policy disposition when you refuse a Breathalyzer test you do not get the benefit of a reduced offer," Merges said.
Fennell's attorney said he expects the sergeant will keep his job.
"It places no barriers for him to go back to work," Kevin O'Brien said of the sentence.
Fennell, 39, who has 11 years on the force, was charged Nov. 6 with drunken driving, leaving the scene of a property-damage accident, imprudent speed and refusal to submit to a Breathlyzer
Police received a call around 3:45 p.m. from someone at KT Barnside Eatery in Selkirk area of the town who reported that a take-out customer who appeared intoxicated had just left the restaurant. As officers were heading to the scene, police received a report of a car accident near the restaurant.
Fennell allegedly rear-ended a car at the intersection of routes 9W and 396. As a Bethlehem police officer stopped to talk to the driver of the first vehicle, police said, Fennell pulled out around the first vehicle and fled the scene.
Fennell then drove off the right side of the road and hit a tree a short distance away on Beaver Dam Road.
Optimists close their eyes and pretend problems are non existent. Better to have open eyes, see the truths, acknowledge the negatives, and speak up for the people rather than the politicos and their rich cronies.
