U.S. Drug Policy Would Be Imposed Globally By New House Bill

The House Judiciary Committee passed a bill yesterday that would make it a federal crime for U.S. residents to discuss or plan activities on foreign soil that, if carried out in the U.S., would violate the Controlled Substances Act (CSA) -- even if the planned activities are legal in the countries where they're carried out. The new law, sponsored by Judiciary Committee Chairman Rep. Lamar Smith (R-Texas) allows prosecutors to bring conspiracy charges against anyone who discusses, plans or advises someone else to engage in any activity that violates the CSA, the massive federal law that prohibits drugs like marijuana and strictly regulates prescription medication.

"Under this bill, if a young couple plans a wedding in Amsterdam, and as part of the wedding, they plan to buy the bridal party some marijuana, they would be subject to prosecution," said Bill Piper, director of national affairs for the Drug Policy Alliance, which advocates for reforming the country's drug laws. "The strange thing is that the purchase of and smoking the marijuana while you're there wouldn't be illegal. But this law would make planning the wedding from the U.S. a federal crime."

The law could also potentially affect academics and medical professionals. For example, a U.S. doctor who works with overseas doctors or government officials on needle exchange programs could be subject to criminal prosecution. A U.S. resident who advises someone in another country on how to grow marijuana or how to run a medical marijuana dispensary would also be in violation of the new law, even if medical marijuana is legal in the country where the recipient of the advice resides. YUP......cut everything and make it on your own....because the government handouts WILL NEVER BE ENOUGH.....that's what happened in Rome....the government pretended to have storehouses(form of comfort) to satisfy all on
a large scale for a long time(of which was not true) and the plebs became satiated and things were STILL just as unequal.....

Colorado's top federal prosecutors are mum about possible actions against state marijuana dispensaries after notice of a crackdown in California.

The federal government has warned dispensaries nationwide they could be subject to prosecution because most marijuana use is still barred by federal law. This week, at least 16 dispensaries in California were told to shut down within 45 days or face prosecution.

In Denver, Drug Enforcement Administration spokesman Mike Turner said nothing has changed in agency policy, which calls for concentrating on major drug trafficking organizations.

"We wouldn't comment on any pending operations, but there's no change in our stance," Turner said. "It's always been the same."

U.S. Attorney John Walsh was out of the state Friday and unavailable for comment. His spokesman, Jeffrey Dorschner, declined to comment.

For Colorado's medical marijuana centers, the immediate impact of the California crackdown is "virtually none," according to Jeff Gard, a Boulder attorney who represents many medical marijuana centers.

Gard said Colorado's tightly regulated industry sets it apart from California, where dispensaries can sell cannabis to people issued medical cards from out of the state.

"The most unique component is that Colorado medical marijuana businesses have to grow their own medicine, so it's a closed loop," he said. "We are Colorado residents working with Colorado patients, and we grow our own medicine in the state of Colorado under the supervision of the state of Colorado."

Gard added that California doesn't track the source and supply of marijuana, making the state an easier target than Colorado for prosecution by federal regulators.

"By being responsible, by being accountable to the state of Colorado for everything that happens, it makes it very, very difficult for the federal government to then prosecute medical marijuana folks."

Colorado's medical marijuana enforcement program is developing a radio-frequency tagging system for plants as a supplement to the cameras already installed in dispensaries used to monitor sales and growing operations.

"We can track it from the very moment it's a seedling all the way until it becomes medicine," Gard said. "It's all information that's provided to the state on a daily, hour-to-hour, minute-by-minute basis."

Tom Sloan, commander for the Boulder County Drug Task Force, said the federal attorney in the state has given no indication that U.S. officials will clamp down on local dispensaries.

Owners of medical marijuana facilities in Boulder say Colorado's strict regulations may help ward off threats like those delivered by federal prosecutors in California.

"Within the state, I think Boulder's probably one of the best places ... to be situated because we also have our own local regulations that we're following," said Diane Czarkowski, an owner of Boulder Kind Care.

Figures from the Colorado Department of Revenue show there are about 800 dispensaries, 300 infused-product manufacturers and more than 1,200 cultivations operating in the state.

The marijuana business in Colorado began to flourish after then-Deputy Attorney General David Ogden issued a memo to federal prosecutors in 2009 that said drug enforcement should not focus on those in compliance with state medical marijuana laws.

But last June, the Department of Justice issued a memo to federal prosecutors stating that marijuana dispensaries and licensed growers in states with medical marijuana laws could face prosecution for violating federal drug and money-laundering laws.
