SCHENECTADY -- Police said Monday that autopsy results show the death of a 20-month old boy was a homicide.
Officers and medical personnel were summoned shortly before 10:20 p.m. Sunday to 611 Hattie St. on the city's north side for a report that the tot was not breathing. The baby was later transported to Ellis Hospital, where he was pronounced dead.
John Betease, the boyfriend of the baby's mother, was arraigned Monday on an unrelated charge of first-degree criminal contempt, according to authorities and court papers. The 32-year-old Betease was sent without bail to Schenectady County Jail pending a future court appearance. The criminal complaint alleges that he violated a stay-away-order of protection by calling a woman named Robin Shipley.
It's unclear if she is the child's mother.
Betease was convicted of criminal contempt in April 2009, according to court papers.
Public Safety Commissioner Wayne Bennett has said a person carried the boy to a neighbor, who then called 911.
The investigation is being jointly handled by the department's Youth Aid Division and State Police.

It's so horrible that the first homicide in Schenectady this year is a 15 year old and the second is not even two. The implementation of Jim Tedisco's Safe Schenectady plan needs to take place now.

SCHENECTADY - One person ran up the street to the fire house to find help. One person performed CPR on the 20-month-old boy. And, another person frantically called 911. But, despite all the efforts, Asiah Maxam died Sunday.
The neighbors sat near the growing memorial Tuesday afternoon, recounting the terrifying sight of looking at the child's lifeless body. The child's mother, Jamie Darrel, says her boyfriend was watching the baby Sunday when he fell out of a play pen and stopped breathing. John Batease carried the baby to a neighbor across the street, Bianca Leather. She called 911.
"I told them there was a baby here, and he wasn't breathing, he didn't have a pulse," said Leather. "He was cold, very cold, he was dead to the touch. There was no saving that baby."
John Batease is already behind bars on an unrelated charge of violating an order of protection. Police are questioning him. NewsChannel 13 found out he has a criminal record involving domestic violence and grand larceny.
Tuesday, Schenectady Police were extremely tight lipped about the case. They still won't confirm how the baby died. But, they do say no one has been charged yet.

DV cheers for spending money on government hair salons, government gin mills, goverment theaters, etc as well as cheering for stealing money from taxpayers to give it to the millionaires -- all that wasteful spending at all levels of government when the government should have been spending the money on programs and such that would prevent stuff like this.
