SCHENECTADY-- A judge erred when he ruled in favor of the city police union in a dispute with the city over disciplinary hearings, but the complex issue that could determine the department's ability to fire rogue cops appears far from settled, according to a decision issued Thursday by the Appellate Division of state Supreme Court.
At issue is whether Schenectady can discipline officers in public proceedings headed by Public Safety Commissioner Wayne Bennett and if the city can unilaterally decide that the issue of disciplinary hearings is not subject to collective bargaining.
