While at the the county building this is what was found in their public records............
Index# 2010-349..........is the index # for the malpractice suit against REMS. It is 41 pages long and because it is public information, anyone can see it or get a copy of it at the county building.
The plaintiff is Maria DiMeo, the Executrix of the Estate of Allesandro DiMeo, Deceased
The defendents....Rotterdam Emergency Medical Services, Inc and town of Rotterdam |

Good work Ms. Lazzari so what's your point? Has Mohawk ever been sued, not in Rotterdam but anywhere in the Capital District? To be fair Ms. Lazzari you should be careful what Kelly feeds you. It might be tainted. |

Did Mohawk submit this lawsuit to the town in their proposal to persuade the TB to select them? You know, like REMS did with their proposal. |

First I'm not this Lazarri person. Second, the point is.............Every good intention can end up in court.....yes? Ask the rems folks if these malpractice suits should be the decision maker on a contractual bid? I'd have to guess their answer would be yes since they included a law suit involving their opposition in their bid package. It's called 'leveling the playing field'!!!! |

There is one critical difference....the isolated Mohawk incident was an unfotunate case of miscommunication...Mohawk wasn't there. REMS is flat out malpractice....REMS lost a patient because they spent too much time deciding what hospital to go to....they wanted to take a Schenectady patient with early symptoms of a heart attack to St. Peter's... in Albany... against the family's wishes...and when the patient ended up in cardiac arrest, the paramedics were not on board or following REMS...that's why they are a party to the suit...REMS attempted ALS but they are not qualified to administer ALS. I think REMS was just trying to do everything possible to save the patient...but I don't understand why they did not insist on the continued assistance from the paramedics. |

When filing a suit, the plaintiffs lawyer will bring all of the respondents involved, into the suit, and it may be the judge or jury to find if the respondents will share in the lawsuit equally or if only one of the parties is fully responsible. |

When filing a suit, the plaintiffs lawyer will bring all of the respondents involved, into the suit, and it may be the judge or jury to find if the respondents will share in the lawsuit equally or if only one of the parties is fully responsible.
It's not unusual UNTIL you are competing for a town ambulance bid. Then it suddenly becomes the majority of your bid package against the opposition. |

Ummm how many frivolous suits get filed every day? I'm not saying you are right or wrong...I haven't read it nor am I a lawyer...but I've read lawsuits of people suing fast food restaurants for making them fat...doesn't make it so... And republicans are throwing a fit over medicare/caid amendments because there wasn't tort reform to kill frivilous lawsuits... just cuz some ambulance chaser writes it in a fancy format doesn't make it fact... im not saying its not fact but id think youd be smart enough to know not to believe everything you read in acourt filing |

Yes that's very true....there are more than enough frivolous lawsuits out there...and plenty more that are just plain bogus. |

Our community lost a very nice man, and I think it wa very sad and unfortunate. I think the point here is that REMS should have avoided attacking Mohawk over their issues when the REMS has their own problems.

From today's Gazette:
"The paramedic decided against accompanying the ambulance crew or following them to St. Peter’s, according to the lawsuit. As they departed for Albany, DiMeo’s condition worsened and the ambulance crew was not trained to administer the care to him, the lawsuit states."
Kind of sounds like the paramedic made the wrong call by not jumping in the ambulance or at least following it to the hospital. Still sounds more like a bad judgment call than a malpractice case. |
