SCHENECTADY Woman allegedly stole from mentally challenged neighbor BY STEVEN COOK Gazette Reporter
A scheme to intimidate a mentally challenged woman into handing over money has led to an indictment on larceny and other counts, Schenectady County District Attorney’s officials alleged Tuesday. Marilyn Smith, 47, of 438 Millard St., was indicted on two counts each of fourth-degree grand larceny and third-degree burglary, along with one count of third-degree robbery and other charges. Smith is accused of intimidating a neighbor into giving her money last year, targeting her because the victim was mentally challenged, prosecutor William Sanderson said. “We alleged that the defendant, based on her knowledge of the woman’s diminished capacity, begins to take advantage of her by dominating her,” Sanderson said. The acts extended to telling the victim what to eat, what to buy and making her run errands, Sanderson said. The charges were also indicted as hate crimes, based on the victim’s mental capacity, carrying possible increased penalties upon conviction. .......................>>>>............................>>>>........................http://www.dailygazette.net/De.....r01404&AppName=1
Not sure if that is a hate crime but I do hope they throw the book at her.
"In the beginning of a change, the Patriot is a scarce man, brave, hated and scorned. When his cause succeeds, however, the timid join him, for then it costs nothing to be a Patriot."
The entire notion of a "hate crime" is sickeningly absurd. They are all hate crimes.
"While Foreign Terrorists were plotting to murder and maim using homemade bombs in Boston, Democrap officials in Washington DC, Albany and here were busy watching ME and other law abiding American Citizens who are gun owners and taxpayers, in an effort to blame the nation's lack of security on US so that they could have a political scapegoat."
I looked up the legal definition of hate crime as I was fuzzy on what it involves
A hate crime is usually defined by state law as one that involves threats, harassment, or physical harm and is motivated by prejudice against someone's race, color, religion, national origin, ethnicity, sexual orientation or physical or mental disability. Laws vary by state and if hate crimes are provided for by statute, the defintions of hate crimes and penalties imposed vary. States that have hate crime statutes provide harsher penalites for such offenses.
And here's a link to NY laws regarding hate crimes
Its not a hate crime. Being mentally disabled certainly did not help the victim but it does not sound like an attack on the mentally disabled, rather somebody picking on an easy target. But the defendant is charged with everything that even fits a description so she will plead down to aggravated assault or whatever garbage carries 3-5 years of probabtion, community service and restitution.
A new member, we'll have to see if this is DV in disguise
Optimists close their eyes and pretend problems are non existent. Better to have open eyes, see the truths, acknowledge the negatives, and speak up for the people rather than the politicos and their rich cronies.
