County provided fuel to REMS
John Purcell 02/21/11 FOIL request turns up no records, but official says fuel was obtained
County Attorney Chris Gardner has confirmed that tax-free fuel was provided to Rotterdam Emergency Medical Services on at least one occasion despite earlier claims to the contrary.
Rotterdam Town Supervisor Frank Del Gallo cut off REMS from the town’s fuel pumps on Jan. 6, because, he said, with the failed tax district vote, which would have paid for REMS to continue, the future of the organization was unclear. He said REMS no longer had a contract to purchase tax-free fuel from the town. Since then, REMS has secured an agreement with Pilot Travel Centers as their main supplier and John Ray & Sons as their backup supplier. Since REMS is a not-for-profit company, the taxes can be returned to the company after filing every year.
Earlier this year, Gardner said REMS had not obtained fuel from county pumps, although REMS attorney Frank Salamone said the not-for-profit had purchased gas on Friday, Jan. 7.
On Jan. 11, Gardner said the county does not have a license to sell fuel and “it would not be lawful for us to do so.”
The Spotlight filed a Freedom of Information Law request on Jan. 12 asking county officials to first provide copies of all the records pertaining to the sale of fuel to REMS, but the only document provided on the Jan. 31 response was an internal memo Gardner wrote to Director of Public Works Joseph Ryan regarding the sale of fuel at county pumps.
“This is to confirm that Schenectady County is not currently licensed to sell fuel,” said Gardner in the memo dated Jan. 12. “Accordingly, Schenectady County’s policy is to not sell or provide fuel to any party, except on a temporary basis in exigent circumstances, when necessary to protect the health and safety of the community.”
Since no records on the sale of fuel were given, another FOIL request was filed seeking records of any county fuel provided to or obtained by REMS. The second request yielded no additional documentation.
“I have been informed that there are no additional documents pertaining to your recent FOIL request beyond what has already been provided,” said Geoffrey Hall, clerk of the County Legislature, who dealt with both FOIL requests.
The day after the second request was answered, Gardner said the county did, in fact, provide fuel to REMS.

'URGENT SITUATION'????? What did Hess, sunoco, mobile and cumblerland close???? REMS could have paid the tax and claimed it on their yearly tax filing!! Or are they that broke that they couldn't afford it? No cash flow? |

It was an urgent matter at the time -- and it was only for a short period of time until other arrangements could be made. The fact is that it was purely a childish act of nastiness and revenge to cut off REMS' fuel supply on such short notice. After rigging the referendum so that it would fail, the decision to then stick the knife deeper into REMS by cutting off its fuel supply was the "last straw" for many residents who had hoped for better from the supervisor and the deputy supervisor. Not to worry, these residents will remember these dastardly acts - if and when - those two ask to be reelected. |

fdg did exactly what he should have for the taxpayers. REMS was a private company on Jan 1st. And they also do not have a license to sell fuel. If they were going to sell it to REMS than they could have sold it to Mohawk or for that matter ANY other private business!! I guess fdg was the ONLY one who knew what to do!! And yes people WILL remember these tax saving decisions. The three musketeers not only would have continued to sell REMS fuel, but have hired a legal firm that will bust the budget!! Yes people will remember and remind those who forgot! |

The new legal team will actually do what they are paid to do. The town attorneys work for ALL of the town board and the various boards and commissions --- unless separate legal counsel is provided. As chair of the Parks and Recreation Commission, I can tell you that I have been waiting for up to 13 months for answers to simple questions regarding issues before our commission. The only way to get answers seems to be to look them up yourself or seek outside assistance. |

Only one polling site -- vote scheduled in December --- procedures for the vote so unclear and poorly handled that there were long lines and cause a good number to walk away --- not putting up ALL of the relevant information that I know was available to them --- those are just a few examples |

If the vote doesn't turn out exactly the way the DEMS want-claim fraud-attack the opposition-attack the intelligence of the voters-pitch a fit-make up phony charges. Do whatever you can to thwart the clear will of the people. Delay, postpone, stall, demand another vote. Who at the County authorized this illegal fuel? |

Great job on the FOIL requests Mr. Hall! No records of any fuel transactions? ROTFLMAO!! Than one day later-oops there were several tax free transactions! But no records? Did you actually check this out or just say there are no records? These County DEMS are beyond pathetic. Bravo to the Spotlight-stay on this latest DEM fiasco. |
