Confidentiality Officers, employees, agents and professionals must adhere to all Federal, State, and County laws, rules, and regulations regarding confidentiality in the performance of their duties (e.g., HIPAA, NYS Social Services Law). Care should be taken at all times to safeguard the confidentiality of clients and employees. See Schenectady County HIPAA Compliance Program for more information regarding standards for protecting the privacy of individual health information. |

It is clear that McCarthy not only offended a resident, not only used a medical term as an insult, but obviously doesn't know what the word 'confidentiality' means!! THREE strikes and you're OUT!
On a positive note....if he is foolish enough to run for mayor now.......this video, that we can thank MC1 for, will follow him where ever he campaigns.
Put a fork in McCarthy.....he's done!

And bumble, based on his quote in an apparent interview with the TU, he's actually dug himself a deeper hole. THink about these scenarios.
1. If McCarthy didn't work where he does in the DA's office, and didn't know anything about Burch, then McCarthy's comment COULD POSSIBLY be reasoned as McCarthy is giving his personal opinion of Burch based on Burch's comments alone---this wouldn't cause too deep of a hole
2. If McCarthy didn't work where he does in the DA's office, then McCarthy's comments COULD POSSIBLY be reasoned as McCarthy is giving his personal opinion of Burch based on information that McCarthy might be privy to in his capacity of councilman, e.g. Burch could have contacted Gary about some issue and Burch could have come across to GM as a "wacky whiner" or a rabble rouser, OR e.g., he might be aware of Burch via dealing with the police commish or chief, the police review board, etc, and then it would be viewed as Burch having some criminal history that McCarthy might know about and make an assumption that the guy has mental issues---This would cause a deeper hole than #1, and could potentially open the city and county up to a civil lawsuit for someting along the lines of libel, slander; however the general public could view a suit as Burch has a lot of nerve suing if he has a criminal history.
3. The fact that McCarthy made the mental health comment at the meeting and then followed it up by explaining his personal knowledge of Burch via his employment in the DA's office and "alerting the audience" would lead people---people who have NOT visited this forum---to know that the guy has mental health issues. And that is where McCarthy over-stepped the bounds. THe confidentiality of "customers/clients" of the DA's office AND the violations under HIPPA.
Because #3 (three) is fact, and it's a fact McCarthy oversteped his bounds, he did not try to hide the reason that he claims he knows some facts about Burch. And that's where he has dug himself the deepest hole. And it is this hole that needs to be given major headlines to the people of the city....and then, a call to whether McCarthy's violating of confidentiality and HIPPA make him eligible/able to lead a city.
I think everyone one this board can now say that McCarthy clearly is NOT able to lead the city; exept one---DV will still state that McCarthy will be perfect. |

i really don't care that McCarthy has/had knowledge of this gentleman, ALLEGED knowledge. Makes no difference. Well, yes it does make a difference, it makes what he said even worse.
His comment was disparaging. I only hope that that young man didn't hear McCarthy, comments like that are hurtful.
I'm so pissed that he thinks he can excuse himself by stating, well, I had prior knowledge or whatever. SO WHAT! You suck McCarthy. Pathetic. Man up and admit your mistakes, you'd gain at least some respect by doing that than making your IDIOTIC excuses. YOU are the only one that believes them.
McCarthy, just sit there at the meetings and keep your disgusting, disrespectful and unprofessional mouth SHUT. |

If I was this man I would be looking for a good lawyer.
If I was the Mayor I would be seriously looking at the budget to see where the money awarded to this man will be found. If I was the DA I would be doing the same thing.
There are great lawyers and advocacy groups out there that will be willing to go full speed ahead to nail McCarthy and maybe the City and DA's office too.
What I heard at the meeting was a citizen presenting their concerns. It was McCarthy that planted a seed. It does not matter if this man has a mental illness or not what matters is the ramifications of being given that label. It is not nice.
Working in the field McCarthy does he knows damn well what the laws on disclosure are about.
Give a person enough rope and they will hang themselves. Looks like McCarthy did just that. Keep in mind all the organizations he belongs to and is on committees for maybe they will distance themselves from him too. Maybe "Public" will return to Public Access.
I received an email from a friend who lives in Rotterdam. She is livid about this and I have heard from others from outside the city feeling the same way.
This will be getting more attention then the Mayor and City Council had any inkling it would. It is a reality that citizens cannot express their concerns without retribution in this city. The city council's arrogance is going to bite them big time... long overdue. The disrespect has to stop. |

I would have taped more, but had to hurry and delete some when my camera ran out of space, the memory card. Here is when the first time speaker needs to finish up. This is not a problem

Quoted Text
Don’t make McCarthy mayor by manipulation
Re Feb. 10 article, “Stratton to quit as mayor”: Schenectady mayor Brian Stratton has finally gotten his way, and he’s off to a state position, working with Gov. Cuomo at the Canal Corporation. Of course, Stratton knows little about New York’s canals, and he knows even less about the historic importance of the once-great Erie Canal. During his term as mayor, I cannot recall him ever speaking of the Erie Canal, nor its impact on the history of Schenectady. In fact, he could have created a unique museum honoring the Erie Canal by saving the Silver Diner and encouraging its transformation into such a museum and tourist location. But he demolished the diner in secret and created yet another asphalt eyesore in its place. Stratton’s personality has allowed few questions about his actions, and anyone daring to criticize him faced his anger and potential retaliation. I wonder if these personality traits will sink him at the Canal Corporation. But let’s examine his possible replacement, Gary McCarthy. Already known for his strong need to control city politics and politicians, McCarthy’s reign as City Council president has been marked by his unprofessional and childish insults directed at members of the public, his questionable handling of vacant properties and his ruination of public access TV. Now City Council members are looking for ways to let him be a part-time mayor in a city that desperately needs a full-time leader. McCarthy has long wanted to be mayor and still smarts from his loss in a previous mayoral race. So, it’s time to stop this incredible and possibly illegal manipulation of city politics, giving no regard to the needs or desires of the people. McCarthy and his cronies think they own this city; we need to show them they don’t!

Gary McCarthy's "ruination of public access television". Right on the money! His idiotic public comments were beyond the pale but McCarthy will be long remembered for his engineering the hostile takeover of SACC-TV. Serving it up to Mercury Morris to turn into 3 unwatchable propaganda channels. No one thinks this is any improvement and no one will forget who made this happen. |

It's been over two weeks since Stratton announced he is fleeing the City. When is City DEM Chairman Richard Naylor going to make a definitive statement? The people want to know who will be interim Mayor. This is what happens when you have complete one party control. No one demands any answers. If Gary McCarthy is going to be interim Mayor say so today. Hemming, finger in the air, waiting for divine intervention. The longer this drags on the worse for the DEMS. The lack of leadership and passivity is unbelievable. The City has been left in a fiscal lurch we can't wait weeks for someone to make a decision. |

First - the Mayor is not "fleeing" the city .. he is getting a promotion in recognition of the good work that he has done.
Second - the Mayor has not left yet ... there is no rush to name a successor
Third - judging by the comments of the Nattering Nayboobs of Negativity ... Jesus Christ could be appointed as interim Mayor and the NNN's would rip him to shreds. Nothing pleases them ... they are chronic complainers. |

The Mayor is fleeing the mess he created. He spent 2 years desperately looking for any State job lob and finally hit the jackpot. He left a fiscal wreck that will take others years to correct. But one governmental bean counter thinks he did a job. Since the DEMS obviously have no electable candidate-McCarthy shot himself in the foot-announce today that Roger Hull will be interim Mayor. Stop the Madness. In November, Roger Hull's name can be on every line. |
