The racetrack users packed the Council Chamber...but Della Villa did all of the talking...stressing the Industrial Zone status of the property.
The Board has instructed the PD and code officials to aggressively pursue evidence of racing...guess the DVD didn't convince them.

DiLeva assured them of every effort to resolve the matter acceptable to both parties...the residents and the kids.

Also, the retirement "target" list was voted down 3-1...Bob Godlewski voted yes.

On another note...Parisi refused to sign a consent form for outside council to defend the Town in the case involving the recent illegal
meeting...insisting that the Town has no chance and should not waste the money.

Since the retirement incentive list was defeated -- this pretty much negates the law suit --
since the whole point of the "special meeting" was to allow the town to participate in the
retirement incentive .. and, after this vote tonight,  apparently will NOT be participating in.

My understanding is that even though the initial decision of whether it is a racetrack or not is
the code enforcement/building inspectors decision --- but that decision can be appealed to
the Zoning Board of Appeals by either side  (landowner or neighbors) ...  and ultimately it
could be decided by the Town Board.

That is the first step .. but the neighbors could then appeal the decision - if he says it is NOT
a racetrack   .. similarly, the landwoner could appeal the decision - if he says that it is a
racetrack.     The appeal would be to the Zoning Board of Appeals.

BTW:  In no place does the race track code reference Light Industrial, or any other type of zoning.  That point is moot.  The race track code references a "special use" of property (zoning independent) for a specific purpose, which currently is unapproved.

OK, so back to conversation:
So just enforce the Code!
Can't enforce it unless the code enforcer sees it!
Wait a minute, we just did this!
I know, ain't it great, only in Rotterdam!

simple noise code violation in which police can issue warnings and tickets.....  look it up in town code.

all residents in ear shot of this fiasco, call the police department with complaints, should have happened since day one.


this administration continues to be a joke........

I know that the residents have several videos of the racetrack  in operation ...  the opinion
of the town attorney is that the video alone is NOT enough to take action.
Frankly, I am not sure that this opinion is correct.   I believe that the residents should consult
an attorney and see if there is a way to use the video -- and force someone to enforce the
town law that has been on the books for decades.
It seems to me that it would be very easy to prove that the property owner does NOT have a
special use permit to operate a racetrack ...  and the town law requires both a special use
permit and proof of liability insurance  ( I believe $1 million) -- couldn't the town take the
course of requesting that the property owner prove that he has the necessary insurance ?
It seems to me -- after the Agenda meeting -- that the town is being told that there is only
ONE way to resolve the issue .. and that is through some written opinion of the code enforcer ...
I believe that there are several ways to resolve the issue  .. ways that the residents would have
to work together and pursue.
