I ran into a friend of mine who lives by this racetrack. He said that there has been a little less activity lately. Perhaps they got the message and know that they have to apply for a zone change for this type of racetrack.

Don't know why the Town would need to amend the Code. The Westside Track has no permit, no insurance for a track and it is disruptive to the neighborhood and violates the noise code. Can't the Town simply enforce their code?

Noise abatement regulations are another thing -I have had occasion to work in cities that have very elaborate noise abatement laws- they are specifically written to deal with and decibel levels during hours of the day- such as - noise associated with construction ( that has a permit ) noise associated with property permanence is different barking dogs high decibel activity- such as jackhammering - high decibel levels require a certain break - every number of minutes

I think if you Google Earth the property you will clearly see a well defined path (track) and four wheeler tire marks (tracks) visually apparent. It is DEFINITELY a race track pursuant to the Rotterdam Code. Also clearly violates the Code. Also is disruptive to the neighbors which is also a violation of the Noise Code. Personal property has nothing to do with it. When you live in or adjacent to Residential the laws and codes are designed to protect against egregious activities, that's why they're on the books!

The dude has been arrested and did time in jail for violation of environmental laws, his son lives with his mother in Duanesburg and brings his buddies there to race (they aren't even Rotterdam residents). The track brings no tax dollars into the town, so has no value to the municipality. The residential neighborhood is long established pre-dating this dude's property purchase. No one has the right to do whatever they want on any property! When you present a plausible argument, semi-intelligent rationale, post it and I'll smoke you again!
