But they can't change the law, no matter how much pull they have.  The letter stated facts - I think they'll be able to rest on that.  Who knows though.

But the town is NOT denying people with disabilities a place to live. That is the scam!! That is exactly what the owners and the ones who represent them want the sheople to think.

This is between the renters and their landlord and representatives. The renters have been dooped too! They have been used as pawns and turned into victims to benefit the property owners and those that represent them. IMO

Public sentiment turned FOR Sync because of the "disabled" issue. Thanks to that lady who runs Mohonasen (you know the one who has 17 Phds yet doesn't have common sense enough to pour piss out of a boot) sending the letter vilifying the handicapped kids. So this puts the icing on the cake and gives the admin' political "cover" as you can be sure that when they cast that vote to uphold the zoning change they will cite the "horrendous " and "illegal" and "discriminatory" nature of those wishing to "kick out" the disabled kids...HAHAAAAA. That was politically artful, having the disability and discrimination cards at the ready once Mrs. Spring stepped in it!

They are easy targets no matter which way they vote. Galesi donates every year to the Dems and Sync donated to them also. It's easy to say they voted a certain way cause of the money trail which runs both ways...

I would like to know who and how these owners got a CO in the first place!!




The attorney for Sync Realty, Donald Zee, indicated that he had documentation that confirmed the date when the Federal Government certified that the facility was used for residential.  Apparently less than a year passed when the grounds were again used for residential living.  As a result of this, the Special Use Permit would continue according to Rotterdam Law.  This being the case, I would think there technically is no need to get a rezone since the Special (nonconforming) Use is continuous and would have to be allowed.  The nonconforming use does not appear to expire with a change of ownership.  So if the pre-existing use has to be allowed, it would seem to me that a rezone is NOT a requirement for those renters to continue to stay there.  I'm not sure if the prior NYS Supreme Court ruling is aware of this info when they made their decision.  If not, I would say the continued use never was interrupted for more than a year, and the Special Use would continue.  Not a lawyer, but seems as though the Town would have to allow it.  All can go on the Town site and verify this info since all I did was cut and paste it into this post.

The following is from the Town of Rotterdam Codes Chapter 270 Zoning
Article XIX  Special Use Permits
§ 270-169 Expiration; amendments; resubmission.
A. Expiration. In any case where a special use is not in operation within one year after the date of granting thereof, the special use or authorization thereof shall be null and void. Further, a use shall expire if such use shall cease for more than six consecutive months for any reason.

I dont give a rats you know what about the disabled kids....but I CERTAINLY HAVE AN ISSUE WITH THE SCHOOL BOARD AND ESPECIALY THE TOWN FOR THEIR LACK OF FORWARD THINKING......

AS for the sewers....ya'll know how I feel.......'get er done.'........I thought maybe this wouild be understood.....

Town talks rezone: Sync Realty-owned apartments to be rezoned

A public hearing for the rezoning of family style apartments in the Town of Rotterdam has created a range of different opinions, with town board and local school officials weighing in on the issue at 7 p.m. on March 23.

The meeting of the Town of Rotterdam will include a public hearing to discuss a proposed amendment to property on 325 Duanesburg Road, owned by Sync Realty Group, Inc. The owners are requesting a change of zoning from light industrial to multiple family residential. The property, a former army base, was bought by Sync Realty in 2008 at a Federal Government auction for $1.8 million, according to information provided by Rotterdam Town Supervisor Frank Del Gallo. According to the information, Sync Realty was told by town building department officials that the apartments “were a permitted use” for the property. After town building inspectors looked at the property, and violations regarding fire alarms were fixed by the owner, the owner began to rent out the properties. In August of 2008, Sync Realty was sent a letter from the Rotterdam Building Inspector Mickey Maher stating that the use of property as apartments was illegal. After appealing the decsison to the Zoning Board of Appeals for the Town of Rotterdam, with the board siding with the town, Sync appealed the decision to the Supreme Court of the State of New York, who upheld the decision.

Former Town Attorney and current Town of Rotterdam Board member, Republican Gerard Parisi, said in a release the former administration worked to enforce the laws of the town among all residents and not only those who "carry political clout." According to Parisi, the planning board for the town issued a recommendation against Sync's change of zone request, citing structural and safety concerns and believes that the move by the town board to hold the public hearing in regards to the property is a return to political favors for campaign contributions.

"The motives behind this property and this new board in granting this zone change is suspicious," said Parisi. "My fear is that this new board is not listening to any concerns of the residents." In the release, Parisi states that the criticism is not aimed at any political party, but a system "that lingers in Rotterdam politics."

During the 2009 election, Sync Realty Group gave $1000 to the "Revitalize Rotterdam," campaign. A contribution that Del Gallo said does not carry any weight in his decision for the public hearing or any future resolution.

"You can't buy me for $1000, you cant buy me for a million," said Del Gallo. "If someone thinks they can buy me, they've got the wrong guy."

Del Gallo said after inspecting the apartments himself that they are respectable and well worth the price asked by the owners. "I don't have a problem with the place at all," said Del Gallo. if the dead to sync's or Galesi's property as an easement with relation to sewer service
i would think the fed's put one in when they sold the ind park and kept the housing
to bad the county clerks office is only open 8-4
while some of us work

I think you are being a bit too harsh. People (not me) voted for these people on what they campaigned on. It is these elected officials that are not and did not keep their campaign promises.

This administration has 'nothing' on the last 'few'! This administration will go down in local history as being the most dysfuntional for sure! It is 'tweedle dee and tweedle dumb' for sure!
