Price Chopper is seeking $1.62 million in compensation, claiming the bankrupt Penn Traffi c was in breach of contract when it sold all 79 of its stores to Tops Supermarkets earlier this month. Chief Executive Officer Neil Golub said Price Chopper’s $54.4 million contract to buy 22 P&C Food supermarkets was used by Penn Traffic and its creditors to urge others into the bidding. He said the contract Price Chopper reached with the company in December should have precluded it from seeking the $85 million deal that was eventually reached with Tops. “It was our bid that was used to influence other stores in other bids,” he said Wednesday. “They know what they did and they’re going to have to work their way through it.” Calls placed to attorneys representing both Tops and Penn Traffi c were not returned Wednesday. Price Chopper was in negotiations to buy stores in Canton, Potsdam, Gouverneur, and Massena for $12.3 million before Penn Traffic’s bankruptcy proceeding began. Afterward, Golub said his company attempted a joint agreement with Tops to buy Penn Traffic’s assets, but the deal never happened. Later, Price Chopper expanded its offer to include the 22 stores. Price Chopper buying six former P&C markets SCHENECTADY — Price Chopper Supermarkets, headquartered in Schenectady County, has entered into a purchase agreement for six P&C stores from Tops Friendly Market, the company announced Thursday. The acquisition, which is expected to be completed in April, would give the family-managed chain 125 stores in six states. The stores are in Canton, Gouverneur, Massena, Potsdam and West Carthage, all in northern New York, and Lincoln, N.H. These are some of the same stores Price Chopper tried to acquire last year from bankrupt Penn Traffi c. Price Chopper plans to clean the facilities, replace and add fixtures and production equipment, replace all front end registers and computer systems, and replenish all product on the shelves and displays. Price Chopper also expects to open stores over the next year in Warwick; Middletown, Conn.; and Shrewsbury, Mass. Store expansions are under way in Barre and Essex, Vt. Price Chopper had tried to buy 22 P&C stores for $54.4 million from Penn Traffic in December. Instead, Penn Traffic sold all 79 stores to Tops through a bankruptcy proceeding. Price Chopper then sued Penn Traffi c for breach of contract, seeking $1.62 million in compensation.
