Defendant testifies shooting was justified

    A Rotterdam man told a Schenectady County Court jury that he was defending his wife in December 2009 when he used a shotgun to shoot her alleged attacker, the boyfriend of his live-in niece.
    Prosecutors, however, attempted to counter Brian Simmons’ arguments, suggesting through a rebuttal witness that his wife complained of no injuries in the immediate aftermath of the shooting.
    Simmons attempted to recount for the jury his version of the events of early that morning. His testimony was frequently laced with profanities.
    Simmons alleged that the boyfriend, 24-year-old Joel Winkler, was not supposed to be in the home and was attacking his wife, Penny Simmons.
    At one point, Simmons said it appeared as though Winkler had his wife in a headlock. “I was coming hells bells now,” Simmons told the jury.
    Simmons said he attempted to pull Winkler away but that Winkler swung at him, hitting Simmons in the arm.
    Simmons ultimately grabbed his shotgun, the one he intended to use to go deer hunting the next morning, and loaded it. He warned Winkler through a string of expletives and opened fire, he told the jury.
    “I don’t think he heard me,” Simmons told the jury. “What happened next is I shot him. I got my niece out of the way, shoved the gun in there and fi red.”
    Winkler was hit in the armpit area and survived.
    Simmons, now 53, is accused of shooting Winkler as the culmination of an ongoing dispute between the two men.

Man found guilty in Rotterdam shooting

    The Rotterdam man charged in connection with the wounding of the boyfriend of his live-in niece was convicted late Wednesday of fi rst-degree assault.
    In convicting 53-year-old Brian Simmons, the Schenectady County Court jury rejected his claims that he was justified in shooting 24-year-old Joel Winkler Dec. 8, 2009. Winkler survived.
    Simmons’ attorney, Steve Kouray, had argued at trial that Simmons was stopping a man who had entered the house illegally and was attacking his wife.
    Prosecutor Amy Monahan, however, argued the shooting was the culmination of a long-running dispute Simmons had with Winkler and that it followed a fi ght Simmons started as a pretext to shooting Winkler.
