Morning raid leaves police empty-handed

BY STEVEN COOK Gazette Reporter

A Monday morning police raid on Duane Avenue resulted in four people detained, but ultimately no arrests, police said.
The raid prompted complaints from one of those detained, Crystal Dzintars, 26, saying they had done nothing to warrant a police raid and even suggested police were looking for prior residents who moved out two months ago.
Police spokesman Sgt. Eric Clifford said police have been investigating the residence at 214 Duane Ave., Apt. 1, for more than two months, using an undercover informant to purchase drugs. The most recent purchase, Clifford said, was within the last two weeks, leading to Monday’s raid.
No drugs were found during the raid, Clifford confirmed. The suspect accused of selling the drugs was not there and police are still looking for him, Clifford said.
Dzintars, who said she moved into the apartment Sept. 1, said nothing like what police described has happened while she’s lived there.
“We don’t deal with people who do drugs,” Dzintars said. “It’s dirty and it’s nasty.”
Dzintars rented the apartment; her sister and her sister’s 18-monthold child have been staying there for a week. Boyfriends of the two women were also there during the raid.
All four were detained in handcuffs as police searched the home, she said.
Dzintars said they were asked about someone, but she said none of them knew the person. She said she later asked neighbors, who believed the person lived there prior to her moving in. ............................>>>>........................>>>>............http://www.dailygazette.net/De.....r01501&AppName=1

Dissolve them all and let's just use the State Police!

Four suing city over Duane Ave. drug raid

BY STEVEN COOK Gazette Reporter
Reach Gazette reporter Steven Cook at 395-3122 or scook@dailygazette.net.

Four separate lawsuits have now been filed relating to a November 2009 city drug raid that uncovered no drugs.
Kevin Murdie and Crystal Dzintars, both of Middle Grove, and Charles Wise and Jessica Dzintars, both of Schenectady, filed the suits recently in state Supreme Court in Schenectady County.
The four, in separate suits against the city of Schenectady, are seeking damages, claiming assault, battery, false imprisonment and illegal search in connection with the Nov. 2, 2009, raid at 214 Duane Ave., Apt. 1.
Two of the four, Crystal and Jessica Dzintars, also claim they were strip-searched.
Police have said they were acting on a search warrant and information that placed the target of the raid at the address 11 days earlier.
But Crystal Dzintars, 27, has said the residents had done nothing to warrant the raid and suggested police were looking for people who moved out two months earlier. She said previously she moved into the apartment in early September 2009.
Police later arrested the man elsewhere who they say was the target of the raid. That man was accused of selling a total of $220 worth of cocaine at that address in June, July and October 2009. Police have said timeliness is taken into account by judges considering search warrants. ....................>>>>.................>>>>....................http://www.dailygazette.net/De.....r00803&AppName=1

If past actions were followed the drug dealer was tipped off that they were under investigation and moved out.
