NOTICE OF ADOPTION OF LOCAL LAW No. 2 of 2009 COUNTY OF SCHENECTADY NOTICE IS HEREBY GIVEN that Local Law No. 2 of 2009, introduced as Proposed Law No. 2 of 2009, was adopted by the Schenectady County Legislature at a meeting held on August 11, 2009. NOTICE IS FURTHER GIVEN that Local Law No. 2 of 2009 is entitled: A LOCAL LAW ESTABLISHING THE TOXIN FREE TODDLER AND BABIES ACT BE IT ENACTED by the Legislature of the County of Schenectady, as follows: Section 1: Intent and Purpose. This Legislature hereby finds that Bisphenol A ("BPA") is a chemical commonly contained in polycarbonate plastics, including baby bottles and cups designed for use by young children. This Legislature also finds that some studies may suggest that BPA is a synthetic estrogen which may disrupt healthy human development and that studies have suggested a possible link between BPA and an altered immune system, hyperactivity, reproductive health problems, increased risk of breast and prostate cancer, obesity, and diabetes. This Legislature further finds that some amounts of BPA may be released into beverages from containers under certain conditions. This Legislature expresses concern about exposure to BPA to infants and young children. This Legislature further finds that several states and federal legislators have started considering a ban or a phase out of BPA in beverage containers designed for use by young children. This Legislature finds that Schenectady County is committed to protecting the public health and welfare of our County's infants and young children who may be vulnerable to potential health hazards. Therefore, the purpose of this local law is to reduce the exposure of infants and young children to BPA. Section 2: Definitions As used in this law, the following terms shall have the meanings indicated: A) "CHILDREN'S BEVERAGE CONTAINER" shall mean any unfilled bottle, cup, cup lid, straw or other container intended to be used by children under the age of three (3) years old for the consumption of liquids. B) "BPA" shall mean Bisphenol A. C) "PERSON" shall mean any natural person, individual, corporation, unincorporated association, proprietorship, firm, partnership, joint venture, joint stock association, or other entity of business of any kind. Section 3: Prohibitions No person shall sell or offer for sale children's beverage containers that contain BPA within the County of Schenectady. Section 4: Enforcement This law shall be enforced by the Schenectady County Department of Health in accordance with the provisions of this local law, the Schenectady County Charter and the Administrative Code of the County of Schenectady. Section 5: Authority to Promulgate Rules and Regulations The County Manager, in consultation with the Schenectady County Department of Health is hereby authorized and empowered to promulgate such rules and regulations as he or she deems necessary to implement this law. Section 6: Penalties Any person who knowingly violates the provisions of this law shall be subject to a civil penalty of five hundred dollars ($500) for an initial violation of the law and a penalty of one thousand dollars ($1,000) for each subsequent violation. Section 7: ApplicabilityThis law shall apply to any and all actions occurring on or after the effective date of this law. Section 8: Severability If any clause, sentence, paragraph, subdivision, section or part of this law or the application there- of to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this law, or in its application to the person, individual, corporation, firm, partnership, entity or circumstance directly involved in the controversy in which such order or judgment shall be rendered. Section 9: Effective Date. This law shall take effect on the ninetieth (90th) day immediately subsequent to its filing in the Office of the Secretary of State. I wonder...do you think that the DOH personnel are going to be working overtime during the summer now? Going garage sale to garage sale in pairs, the first going and warning someone that the baby bottles they are trying to get out of their house because they don't need them any more contain BPA, the second one enforcing the penalty as they were informed, yet did not take the baby bottles "off the market?"

Stephen Boese recently found out he has the chemical bisphenol A in his body. And he doesn’t know how it got there. The executive director of the Learning Disabilities Association of New York State said he learned about the traces of BPA in his body after getting preliminary results as one of 12 volunteers who participated in a national biomonitoring study about the effects of the chemical, set to be released in February. “If it’s in me then it’s probably in my children,” he said Thursday, standing at Troy’s Economic Opportunity Day Care Center, where children played in a nearby playground. “We really have to do something about it.” Bisphenol A, a chemical used in many everyday products, including baby bottles, canned formula and foods, is the target of legislation unveiled Thursday by U.S. Sen. Charles Schumer, D-N.Y., that would ban the chemical in products intended for kids age 3 and under. Called the BPA-Free Kids Act, the law, expected to pass in June and take effect within 180 days, would dramatically ramp up enforcement of the ban, including stiff penalties for manufacturers, importers and stores that are found to be in violation. The legislation will also require testing of materials used to make plastic containers to ensure finished containers are BPA-free. Schumer touted an article from Consumer Reports that shows levels of BPA are present in humans at a much higher level than previously thought, and that a single serving of foods delivered in certain containers could lead to the ingestion of BPA in amounts much higher than currently recommended by the FDA. The report included findings from tests of canned foods like tuna, soups, juice and green beans that found all 19 name brand foods tested contained BPA, even products in cans labeled BPA-free. The study also found BPA in the canned liquid Similac Advance infant formula and in canned Nestle Juicy Juice. Schenectady County Legislator Angelo Santabarbara, R-Rotterdam, a cosponsor of the Schenectady County BPA ban, which took effect earlier this year, stood with leaders from Albany County and Suffolk County, areas that have enacted similar bans, as Schumer announced his proposed legislation Thursday in Troy. Schenectady County’s BPA ban law affects only children’s beverage containers, not food and beverage cans.
