Schenectady County lawmakers may have had their hearts in the right place last year when they passed a law banning text-messaging while driving, but their brains appear to have been another matter. More than four months after the law took effect, local law enforcement agencies say they’ve yet to write up a single violation. And the reason isn’t that motorists have suddenly stopped engaging in the suicidal behavior. As a story in Wednesday’s Gazette made clear, the law is practically impossible to enforce. A cop can’t tell whether a motorist who is holding a cellphone is actually “texting”— tapping the alphanumeric keys on a cellphone to create an electronic message — pressing an automatic redial button to make a legal cellphone call, or even surfing the Internet, which, though just as dangerous as text-messaging, isn’t proscribed. Why bother writing a ticket when someone with a halfway decent lawyer is going to beat the rap, or at the very least tie up prosecutors for more time than the offense is worth, demanding phone records, etc.? Then there’s the issue of jurisdiction. A state cop interviewed for the story indicated that because the texting ban isn’t a state law, but only a local one, they won’t enforce it. And troopers stationed in Schenectady County not only patrol a fair number of rural roads, but assist in the city as well. The law isn’t a complete bust, because it has probably discouraged a few motorists from doing what common sense should have told them not to do. But it raises anew the whole question about the “driving while distracted” conundrum. Even before the advent of cellphones, there were countless other things a motorist could fiddle with that were likely to increase the chances of an accident. First it was the radio dial; then the eight-track or cassette player; then the CD. People take their eyes off the road to do other stupid things, too, like reading a road map, directions, even a newspaper; or they’ll apply makeup, shave, or brush their hair. What do you think,,,,,,,, party membership makes you immune to criticism? That's the problem with the party. Republicans took majority of the house of reps in 1994, and in 2000 won the White House. In 8 short years the Republican went back on all their conservative promises and did everything that the democrats did when they were in power. With pet projects, bridges to nowhere, and corruption. Virtually destroying the party.
The few republicans that are left give me no reason to support them. They are just as slimey as any democrat. I'm sorry I can't view the world through the left and right prism that you do.

Eddie Cintron unwittingly made Schenectady County history Thursday afternoon. The 31-year-old Brandywine Avenue man was navigating his vehicle though the city when he became the first motorist to run up against the county’s ban on texting while driving. Lt. Jason Temple was on duty heading toward the Schenectady County Sheriff’s Department in a marked cruiser when he noticed Cintron driving with a mobile device in his hands near the intersection of Nott Street and Van Vranken Avenue, he said. “The guy had his cellphone in front of his face and he was just clicking away,” he said. “He didn’t have a hands-free device or anything.” Having made the direct observation, Temple flagged Cintron and became the first law enforcement officer to issue a “0608 local law” citation, returnable to city court at a later date. The ticket carries no points but a hefty $150 fine. Just two days before the traffic stop, Temple was among a group of patrolmen that expressed dismay that a motorist hadn’t yet been caught. He suggested that the lack of tickets might be resulting from motorists being keenly aware of marked police cruisers and dropping their phones in midtext before getting busted. Temple said that Cintron didn’t admit to the violation. But he said the driver’s actions were plainly visible as he was making his turn. “I guess it’s just luck of the draw,” he said. Cintron could not be reached for comment. County Attorney Chris Gardner said the first ticket is an indication that law enforcement officers are starting to watch for the infractions a bit closer. He admitted that keeping an eye out for a texting driver is a bit more difficult than a motorist talking on a cellphone. “You’ve got to get the police used to looking for it,” he said. “It’s a little more difficult than the police looking out for people using a cellphones.” And the citation in the city may not be the only one. Gardner said a witness to a motor vehicle accident that occurred over the Fourth of July weekend indicated that the driver may have been texting at the time. “We’re hoping this will begin to reduce that particular problem,” he said. Gardner doesn’t anticipate the county seeing a flood of texting while driving citations but does foresee a steady stream. No issues for 4 months, then a puff piece is done (sorry, Justin, but I don't really see a reason for the July 1 story, except for the fact that since the day that the law was announced, there was no news on it). Then, the crack down begins. Don’t look at that phone, it may just be a text message from Big Brother.
...and no, Sal, I don't hate the cops or wish that something would happen to them, like I know you want to reply...I just think that there's more important things they could be doing than driving around looking for someone playing with their phones. I think asking the police to do something like this when there are much bigger issues is ludicrous.
