I would be interested to see how his fellow soldier's testimony holds up during a cross examination at a court marshall hearing. They are running to the media telling their story 5 years after the fact. I wonder how their testimony will hold up in a courtroom under the scrutiny of a military defense attorney. Especially after the Obama Administration(Including Secretary of Defense Chuck Hagel) tainted any chance of a fair hearing, by coming out publicly and calling him a hero. Don't think Obama didn't have his ducks in a row before making this move.
We will see how many high and mid level resignations this move will create, and how many Obama loyalists will replace them. It appears Obama may be restructuring the military and installing his military junta.

Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff said he does not want to prejudge the outcome of any investigation or say anything that might influence a commander's decision. There are a variety of offenses related to an absence without proper approval, and a number of potential actions could be taken by the military. He could be tried by court martial under the Uniform Code of Military Justice for desertion; he could be given a non-judicial punishment for a lesser charge, such as being away without leave. And he could be given credit for time already served while he was a prisoner. Dempsey stressed that any decision would be up to the Army.
I doubt he serves any time based on the five years he was in captivity. I'm guessing he either isn't charged because of some mental defect, or he is charged and gets a dishonorable, general, or medical discharge...which he doesn't give a sh*t about based on his emails
