Excuse me, but can ANYONE state HOW and WHY, left New York STate in 2010, has been in Florida, yet she has continuously had the STAR and other exemptions in effect on her house here?????

Hey all, the new Rotterdam TENTATIVE assessment roll dated May 1, 2013 STILL has her having the exemptions (plural).  

MORE ILLEGAL TAX EXEMPTIONS.


And WE who actually are taxpayers in the town, WE who write out the checks to the town, WE are the ones who are paying INCREASED taxes because DEM CORRUPTION is occurring in the town.

I GUARANTEE her house WILL still have the exemption thanks to the DEM CORRUPTION in the down, and we who are taxpayers will continue to pay higher taxes because of it!!!!!!!!!!!!

i'm no eunie fan....but.....if she was just 'staying' with one of her kids cause she was ill, anticipating she would return, but didn't change her residency....she's entitled....it is done ALL the time.....EVERYWHRE! Not sayin' it's the correct way of doing things.....i'm just sayin.

Nope, by law, she is no longer eligible for a STAR exemption.

If the owner goes into a nursing home that's different, the owner keeps the STAR.   However when an owner has a STAR exemption (or ANY exemption) and they go to stay with their child, sibling, other relative or friend because of illness, they are NOT entitled to keep the STAR (or any other exemptions).  

The thing is though, that fraud is basically allowed because the property owner and the person with whom he/she is "staying with" won't change the address with DMV, won't change voter registration (gee, "stay" with someone out of state for several years and still vote IN New York state??? - yeah  ), doesn't change address with the post office (it's easy if you live in the same community, you go to the owners house every day and pick up the mail), keep the tax bills going to the owner's (now vacant) house, etc.    And it's up to the local assessor to determine if the house (long vacant) is still the primary residence.   And let's see, the last time I checked, assessors are political appointees of the party in power, and when it has to do with a party in power and favoritism given to fellow elected people in the same political party, well, you know what then gets overlooked.   Too bad the average taxpayer who might have an elderly relative living with them who had to give up the exemptions because of "temporarily staying with" someone else.

It seems to me that the whole state has come around to MC's thinking on the STAR issue. MC did not write the rules, but rules they are, and they should either be enforced equally or changed. Those who follow the law are the losers when others don't. There are people in Schenectady who have had their property SEIZED by the government because they did not or could not keep up with the horrible taxes. In what universe is it fair for others to not pay what the law says is their share and not suffer a penalty? Isn't that how this country came about, in large part, over unfair and unequal taxation? Don't kill the messenger.

There are folks that live in nys..........but use FLA as their legal address so they don't have to pay nys tax.........done ALL the time.
There are folks who live in another state....use someone elses address in nys for welfare benefits.....done ALL the time.

There are elderly folks who live 'here' and get the STAR exemption, but have moved in with their kids due to illness. Sometimes they move in on a temporary basis, but they stay longer than expected 'anticipating' they are going to move back to their home....not sayin' it's right or wrong........just sayin'.

And of course politics dictates who gets favored status, i.e., lucrative tax exemptions.   Just like Philip Morris.   And WHY did it take the dems two years to act on it?

I agree with you, bt, there are all kinds of tax cheats. In the case of the STAR exemption, it is much more cut and dried as to who owes what, but in the instance you mention, the elderly person moving 'temporarily', I think that has to be looked at more closely when it does occur. We had the case mentioned elsewhere on this site where the family couldn't sell the mother's house when she passed away and was paying high taxes on a place nobody lived in any longer. I know of similar cases where the house is vacant for years and the family can't get rid of it. In those cases, since the person whose residence it was is deceased, that would be considered illegal to keep claiming the senior STAR. It isn't really any different for a family who has made other living arrangements for an elderly person but still claims the STAR, because a residence is where somebody lives. Maybe there needs to be some kind of waiver for the circumstances you mention, but those instances are rare, I believe, and people are taking advantage of this.

And just how sympathetic are YOU to the financially struggling homeowners in the city, households with incomes less than $40,000 and they have to pay for the property and school taxes of the multi millionaire Galesi?   And HOW sympathetic are YOU, DV, to those homeowners who are basically being told, "if you don't pay for the property and school taxes of the millionaire property owners downtown, then you will lose your own home (even if you've paid taxes for 50 years)"   Just explain HOW sympahtetic are YOU to that??????    Just keep posting here,  cheering for all the wild uncontrolled spending on downtown, but don't post a WORD, NOT ONE WORD of sympathy for the homeowners who can't afford it.  

Tell us how sympathetic YOU are to the financially struggling homeowners in Schenectady who are FORCED to pay for the rehabs/renovations/taxes of all the properties owned by the super rich cronies of the Dems in the city, and thus have no money left after paying for the downtown stuff, and then are being threatened with hefty financial penalites if they don't fix up their own homes!

How sympathetic are YOU to the financially struggling homeowners in the city who are being FORCED to pay for downtown but the homeowners are getting NOTHING in return????

How sympathetic are YOU to the financially struggling homeowners in the city who are seeing their home values tumble, those people in the city who get hit with ever increasing taxes while seeing a reduction in essential services, those who are turning off the front porch lights (used as a crime prevention measure) because they are being FORCED to pay for UNNECESSARY FANCY lighting downtown?

Excuse me, MC is the one who brought out the abuse with the STAR program, and now, at Governor Cuomo's behest, municipalities are scrutinizing their tax rolls and examining new STAR requests more closely. You think the Governor is being ignorant and nasty because he wants to eliminate the fraud and abuse? Wanting to have everyone treated fairly and equally is the American Way.

well, according to the IRS cheating the USA, by their own standard there are no tax cheats.....PRICELESS

STAR shouldn't even exist, it's a political podium puck so we can all sit here and bicker among ourselves....it's a way to 'get the vote'

flat tax will fix everything...but then there couldn't be $-fences built to keep the sheep divided and controlled....
