Shall we educate Mr. Durbin here?  The US Constitution, regardless of the powers of the US Supreme Court, protects free speech...yes?
Blogs/tweets/email are simply extensions of free speech, and therefore are protected under the 1st Amendment....yes?
I think we would all like to know why none of you, after swearing an oath to uphold the Constitution, fail miserably to do so.

In 1776 your actions would be treasonous, and punishable by death.

The arrogance of the extreme left is outrageous.

Bumbler does it again!

The Subject of this Thread:
"Durbin says '1st amendment is out of date"
Is NOT what Durbin says ... But Bumbler isn't interested in FACTS, just agenda!

Durbin questions if the 'media shield laws' should apply to bloggers or tweets.

Well, yeah box; this is the government essentially licensing the press.  If a blogger writes in their blog information the government believes is "sensitive", Durbin is suggesting that the government may have the right to force the blogger to give up their source.  Whereas, if it is a government recognized member of the press, the shield law will protect them and their sources.  This is the corporate media and the federal government attempting to crush internet alternative news.  This is intimidating whistleblowers from talking to news outlets outside of the corporate controlled media, where their anonymity won't be protected.

Durbin is suggesting that the 1st Amendment as it pertains to the free press and this shield law can be applied unequally.

Yup!  The law today applies to "journalists"... If that applies to 'bloggers' is yet to be determined.

In other words this NAZI wants the government to license and define WHO is a journo, or who is officially sanctioned to have free speech. Perhaps during the Revolution, Box would of made sure Tom Paine was executed or sent to a death camp too. I am certain he would not be officially 'sanctioned" as a member of a government-approved press corps.

We all await imprisonment at the desire of the government when peasants such as this animal are in charge, Brownshirts that they are. I understand how evil and despicable these uneducated masses are- and they thrive on revenge and power. Box is a symptom of leftist in all of its basest forms.

"While Foreign Terrorists were plotting to murder and maim using homemade bombs in Boston, Democrap officials in Washington DC, Albany and here were busy watching ME and other law abiding American Citizens who are gun owners and taxpayers, in an effort to blame the nation's lack of security on US so that they could have a political scapegoat."

'media shield laws'
Poor Graham, he's acting like a media shield law protects him or anyone else other than "journalists".

Quoted Text
A shield law is law that gives reporters protection against being forced to
disclose confidential information or sources in state court. There is no federal shield
law and state shield laws vary in scope. In general, however, a shield law aims to
provide the classic protection of, "a reporter cannot be forced to reveal his or her
source" law. Thus, a shield law provides a privilege to a reporter pursuant to which
the reporter cannot be forced by subpoena or other court order to testify about
information contained in a news story and/or the source of that information. Several
shield laws additionally provide protection for the reporter even if the source or
information is revealed during the dissemination of the news story, that is whether
or not the source or information is confidential. Depending on the jurisdiction,
the privilege may be total or qualified, and it may also apply to other persons
involved in the news-gathering and dissemination process as well, such as an
editor or a publisher.

There's a difference box.  A reporter works for news media, a journalist is not necessarily a reporter.  Independent journalists in many cases do not get their information reported.  I'm sure you seen some journalists in Vietnam.

That is why some journalists blog, to get around corporate controlled media that won't report their stories.

It sounds like Durbin may want to exclude the independent journalist from protection to send a chill to any whistleblower that might want to get a story out that corporate media will not report.

Durbin is another one of those left wing nuts that should have been voted out years ago.
