Delhi Charter School In Louisiana Forces Girls To Take Pregnancy Tests, Kicks Out Students Who Test Positive Or RefusePosted: 08/07/2012 3:04 pm Updated: 08/07/2012 11:56 pm


One Louisiana public school's no-nonsense approach to preventing teen pregnancy is "in blatant violation of federal law and the U.S. Constitution," the American Civil Liberties Union says.

According to Delhi Charter School policy, students "suspected" of being pregnant are required to take a pregnancy test. If the test proves positive, or if a student declines to take the test, she'll no longer be permitted to take classes on campus and must either transfer to another school or begin a home school program. From the student handbook:

If an administrator or teacher suspects a student is pregnant, a parent conference will be held. The school reserves the right to require any female student to take a pregnancy test to confirm whether or not the suspected student is in fact pregnant. The school further reserves the right to refer the suspected student to a physician of its choice. If the test indicates that the student is pregnant, the student will not be permitted to attend classes on the campus of Delhi Charter School.
If a student is determined to be pregnant and wishes to continue to attend Delhi Charter School, the student will be required to pursue a course of home study that will be provided by the school… Any student who is suspected of being pregnant and who refuses to submit to a pregnancy test shall be treated as a pregnant student and will be offered home study opportunities. If home study opportunities are not acceptable, the student will be counseled to seek other educational opportunities.

The ACLU is demanding that Delhi immediately suspend the policy, noting that it violates Title IX, which prohibits sex discrimination in federally funded educational programs. Louisiana, probably one of the poorest, most backward state in the Union.  I'm not surprised.

If pregnancy is a medical condition then this is equivalent to forced inoculations required to enter public school or the mandatory physicals conducted before each school year.  It can also be argued that it is a safety concern for the minor, protecting pregnant girls participating in gym class activities and sports that could harm the pregnant student.

Just in case you don't understand this fact... Pregnancy is not contagious... most inoculations are for
diseases that are.  You DID know that right???

This issue has nothing to do with (LOL!) protecting pregnant girls... It was meant to rid the school of
bad examples for the Christian Right's view of a student.  It also insures that if a girl does become
pregnant she will likely not graduate from high school... which is the intended 'punishment'.

If preventing pregnancy among teens is the aim, then they would support programs like Planned Parenthood
who are very successful at preventing teen pregnancy, and at another teen issue... preventing STD'S.

I'm sure PP is making many phone calls right now. They're probably begging Delhi to become the schools 'physician of choice' for these pregnant students.

PP wants to get a hold of these girls before birthright does.

Birthright is a great group... even if they are hard to find in most communities.  For some teens who finds
themselves pregnant, it's a good alternative to abortion.   It's too bad that those Conservatives who cry
and stomp their feet about PP, don't fund Birthright to make it available to all women across the country.

I don't see PP and Birthright as opposing agendas, but rather as alternatives to each others options.

Box, I'm pretty sure there is an annual physical that is required in public school.  It consists of an eye exam, hearing exam, scoliosis exam, and a hernia exam (turn your head and cough).  None of these are contagious diseases but mandated by the public school system in NYS.  You must not think a pregnant teenager is as big of health concern as scoliosis.  Of course not, what am I saying,  you hope the pregnant teen terminates the hidden pregnancy while playing volleyball in gym class.

I know - you cherry picked my post.  I also put in the post "mandatroy physicals before each school year"...since you probably forgot that already.  

The point was, the schools mandate both immunizations and check the physical condition of all studets yearly.  Why would the state school be concerned about a hernia but not a pergnant student?  I seems it would be consistant with the states concern for the childs health.

A school physical would seem to be a good idea to evaluate if all the children are healthy enough to enter school.
A hidden heart condition or illness might be discovered that would limit a child's activity.  
Pregnancy is not a disease, but a natural part of most women's life.  Teen pregnancy is not rare.  Excluding
a student because of a contagious disease is a wise precaution... excluding a student because of pregnancy
serves no purpose except to further alienate the teen.  She has the option to resign from the school year
if it becomes necessary, but in a time when children in wheel chairs, crutches or other special needs are
acceptable at school, why exclude a teen because of pregnancy...
Unless...
Unless of course the purpose of expelling a student is political.

When I was in school, there was a girl that carried a pregnancy full term without anybody in school knowing, and she delivered the baby in her bedroom.  The newborn didn't survive.  Traditional accommodations cannot be made when the pregnancy isn't disclosed.

Box, for a person that wants the state involved in every aspect of a persons life for the "common good", I is funny to see the knee jerk reaction to the states intrusion into an area that flirts with the abortion issue.  That is one thing that liberals allow to trump the state - ABORTION.  When the lefies talk about abortion, it's all about individual rights, you would think they were libertarians.LOL

It is a personal violation on both the 'child' and 'their parents'.

Forcing a child to 'eliminate' their 'own personal' bodily fluid, DEMANDED by a 'public/government' entity is CLEARLY a violation of personal liberties.....again, both for the child AND their parents.
