WTF? Where are the charges for Murder 1? Premeditated murder. The guy thought it was a home invasion. ThePolice went there with guns and did not identify themselves. So in essence they were posing as non-law enforcement officers.

I believe the shooting took place at 1:30 at night, I know if someone was banging on my door at that time I would be armed also. There need to be charges filed and it should be murder for everyone involved in that raid, the fact that they never identified themselves should seal the deal.

1:30am or not, how it can be murder when the resident was carrying a loaded gun? Did the resident ask, who are you? If he was concerned about his safety, why did he answer the door in the first place? don't tell me the resident was confused because of the time... he was alert enough to grab his gun. If it was the other way around, I would expect the resident not to be charged with killing the cop because it was self-defense.
Discipline for the officers? sure Charges? manslaughter at the most. Murder? forget it

I think the charge of MURDER often hinges on INTENT.
I remember an incident in our area where a State Trooper stopped a car at night, in the winter on the NY Thruway. The driver opened the car door and approached the trooper with a snow scraper in his hand. The Trooper thought it was a gun and so shot and killed the man.
The troopers motives were self defense, not murder, and was not charged for the killing.

This is not true, the man was in his doorway inside his house, he has every right to have a loaded gun inside his house. If he had a permit he would have every right to carry a loaded firearm outside his property on his persons.
