NY Court Rules Calling Someone Gay Isn't Slander By THE ASSOCIATED PRESS Published: May 31, 2012 at 6:10 PM ET
ALBANY, N.Y. (AP) — A court says it's no longer slander in New York to falsely call someone gay.
A mid-level appeals court on Thursday wiped out decades of rulings, including its own, to say that society no longer treats false comments that someone is gay, lesbian or bisexual as defamation. Without defamation, there is no longer slander, the court ruled.
"These appellate division decisions are inconsistent with current public policy and should no longer be followed," stated the unanimous decision written by Justice Thomas Mercure of the Appellate Division's Third Department based in Albany. While the decision sets new case law in New York now, it could still go to a definitive ruling by the state's highest court, the Court of Appeals.
Well, it does not cost them money to be labeled gay, so therefore there are no damages.
Understanding why a slander or libel are such would mean, for the individual who is the plaintiff- that there is number one- a falsity, and number two- damages. In order to win such a suit, there has to be proven damages. Damages are financial. For instance- if the person lost their job or their business went defunct.
Certainly, no one cares if someone is gay today, and it may even be considered a badge of honor, especially among democraps. I could care less who is gay and who is not. As far as being a perverted fairy who wants to run people and their small businesses down (and hence the employees of those small businesses who depend on their jobs); then RS is the biggest A-hole on a stick I know.

Yes, and no. Certainly, if you're a pro wrestler, or a pro football player, it's not going to help. Not many kids are going to want to buy a poster of some gay guy to put in their bedroom.
Would you buy say...a muscle car that, the boasts "IT'S THE CAR THAT RICHARD SIMMONS DRIVES"? Remember the ad campaign, "Like Mike", where kids were supposed to want to be just like Michael Jordan? Well substitute that with "I Want To Be Just Like Liberace", and see how many sneakers you sell.

I see, thank you for indulging me. I have seen the name referred to in several posts, and also the name Ronnie has appeared numerous times in some clever but offensive posts, and I was curious if there was some connection. You'll have to excuse my ignorance, as I've just returned from my winter home in the Keys, where I have forgone modern conveniences such as the internet, in pursuit of a more basic and simple life. Rotterdam has always been my first love, and now that I am back for the summer I'm just trying to catch up on the doings in town.
How has the new town administration been faring? Is the new clerk up to the task?
I'm rather confused. I was unable to respond to a reply made by Rampage on this topic yesterday, and when I went to do so this morning I discovered Rampage's comments to be missing. Is there a reason that it was removed??
