Judges orders millions paid in NYC firefighter bias case
By Rose Arce, CNN

Judge ordered New York to pay nearly $128 million to firefighters
Entrance exam designed to keep blacks and Latinos off the force, says lawsuit
"We believe the court's latest opinion is erroneous," says city's counsel
(CNN) -- A U.S. district judge ordered New York City to pay $128 million in to firefighters who allege the city used an entrance exam that deliberately sought to keep African-Americans and Latino Americans off the force. The judge also ordered the FDNY to hire 293 black and Latino applicants.
"It has been in the city's power to prevent or remedy the need for damages proceedings for a decade, and it has not done so," U.S. District Judge Nicholas G. Garufis said in his ruling on the class action lawsuit. He called it the "consequences of the city's decision to ignore clear violations of federal law."
The federal government had sued the city (United States of America and Vulcan Society Inc. vs. City of New York) over fire department entrance exams they said discriminated against black and Latino applicants. A group of black firefighters alleged the city had intentionally discriminated against them, violating Title VII, the U.S. Constitution and state law.
The lawsuit alleged that the exams had little to do with firefighting and instead focused on cognitive and reading skills. Because of the hereditary nature of the fire department, white candidates were recruited and supported throughout the application process by family or neighborhood contacts and whites consistently passed while minority candidates failed..........................>>>>.....................>>>>.....................http://www.cnn.com/2012/03/08/us/new-york-firefighter-lawsuit-bias/index.html?hpt=hp_c1

Can';t read....can't perform....simple as that......discrimination???   hardly......English should be the #1 language...

years ago to become a citizen you had to READ ENGLISH TO pass a test ...night school for many of these people.

So far as exams go.....if you can't read....how the heck can you pass a test.....

Readin is knowledge....and it brings power....evidently the Judge didn't think that way....and the so called minority will find

an excuse to claim discrimination???...would you want the police or firemen to NOT be able to follow directions when doing their

duties....???  what make the test a first grade exam????....SEE SPOT RUN.....SEE SPOT GO....SEE JANE RUN

That's it....change the test.....make it easy.....

liberalism is a mental disorder

"While Foreign Terrorists were plotting to murder and maim using homemade bombs in Boston, Democrap officials in Washington DC, Albany and here were busy watching ME and other law abiding American Citizens who are gun owners and taxpayers, in an effort to blame the nation's lack of security on US so that they could have a political scapegoat."

This is an illiterate rights issue.  We cannot discriminate against the illiteracy our public schools produce.  There should be a congressional hearing on this.  And it better not be only literate people testifying, since how would they truly understand how employers discriminate based on literacy.

A job is a basic right in America, we need to stop discriminating based on literacy.  We need to establish illiterate quotas and mandate private businesses to hire the illiterate at all levels within their company.  Lets stop this war against the illiterate.

education education education....isn't that what has been embedded in our minds????......

and being illiterate can be by choice....laziness.....or just plain GLIB.......

I get pissed to see that some are so passive and go right along with what may be the SYSTEM....
