A third-generation Marine arrested in New York City after trying to check his Indiana-registered handgun with security made an "honest mistake" and should not face prison time, his attorney said Monday. Ryan Jerome, a 28-year-old former private first class whose father and grandfather were Marines, faces three and a half years in prison after being arrested Sept. 27 for carrying a .45-caliber Ruger that was legally registered in his home state.
Jerome, of West Bend, Ind., had approached security officers at the Empire State Building to check the weapon before he was taken into custody, according to his attorney, who said it was the man's first visit to New York City. "Ryan Jerome is neither a criminal nor someone with an illegal gun," his attorney, Mark Bederow, said in an interview with FoxNews.com. "It’s plainly obvious to anyone who looks at the facts and circumstances of this case that he made an honest mistake and was looking to follow the New York laws and be responsible," Bederow said. "He tried to be careful – that’s the irony here." Jerome, who has not been indicted, could face three and a half years in prison if the case goes to trial and he is convicted of carrying the weapon under New York State law. A licensed handgun owner is REQUIRED to know the rules of the state/county he's in, PRIOR to bringing the weapon into that jurisdiction. I'm a registered handgun owner with a concealed carry permit in 39 states (NY not included) - I'd never dream of pulling this stunt, I know the rules, I know the consequences. This man, Marine or not, should have also (and perhaps MORE than I do.
I'm 100% behind Marines and their mission, this man stepped over the line.
Obviously crossed state lines, knownigly bringing his gun....his responsiblity to know the rules...sorry. Plaxico Burress had FLA resgitered gun with him when he shot himself at a nightclub and went to prison....he should have known the law, too. How long had he been carrying a gun in NY without a NY licence, carry permit especially....he knew the law and ignored it.

Ignorance of the law is no excuse for breaking the law. However a district attorney or a judge has a wide discretion if they choose to prosecute the charge, or a sentence if prosecuted and found guilty.

Actually if you recall the Burress situation, if charged with the gun crime, jail term is mandatory and Judge has no discretion from what I remember being reported.
