Yesterday I placed an ad in the Daily Gazette for a flat that I have to rent.
I wanted to put the words No Dogs/Agencies within the ad as I take neither.
The woman I was talking to said "No agencies? That's discrimination." and refused to use that wording. She even consulted her "supervisor." (or so she said)
Now here I am thinking that the whole county has gone nuts.
Where is "no agencies" discriminatory? They have DSS/Sect 8 OK, they allow No Smokers but not No Agencies?
So I am clueless. The second question I usually get from interested potential tenants, if they are on DSS or use Section 8 is "Do you accept DSS or Section 8?
Where is this discriminatory?

The government is the only one allowed to discriminate...They can have 'Senior Housing'(Age Discrimination), 'and Low Income Housing'(Class Discrimination), but yet, a private property owner cannot choose who they want occupying their property. Welcome to the USSA, where property rights no longer exist.
Pat, it sounds as if being an income property owner; you’re just managing the property on behalf of the state. |

But you can't place an ad in the gazetto stating that you will NOT accept Section 8....right? Usually when an ad states....NO SECTION 8.....it means that the rent is too high for section 8!!! Don't make any sense. |

Not taking section 8 has nothing to do with the amount of rent, it has everything to do with dealing with the SMHA (Schenectady Municipal Housing Authority) in the City. They pay 90 % of the rent due directly to the landlord and the tenant is supposed to pay the rest. Section 8 is federal welfare. DSS is local welfare. SCAP is the Schenectady Community Action Program which has within its authority something called the Eviction Task Force. Its all your tax dollars at work folks and if I don't want to play their games I won't. |

The issue I have is simply this, how can saying "No Agencies" be discriminatory? An agency is not an individual. Therefore it is not protected. |

No resolution. I state that fact through my answering machine. The other ad is under "apartments" which doesn't have the Federal Law statement at the top, so it must be acceptable there. Go figure. |

It increased to 90% when the Federal Government decided that people who were "unemployable" also qualified for section 8 housing. It used to be only the underpaid an the disabled. They also allow Section 8 funds to be used toward a "mortgage." Conditions do not necessarily improve. With the section 8 and welfare pools has come a new issue, that of bedbugs in the City. The city doesn't inspect section 8 houses because section 8 does. Conditions of any rental are directly dependent on the tenant. And I never thought the city's rental certificates were a joke. Rental housing has to be safe and the city inspects for that safety. |

I renewed my advertisement for one more week. They were ready for me. I asked them to put in No DSS/Sec 8 and was told No. I argued that they put in DSS/Sec 8 OK and they said that's okay.
Anyway, I can't argue with them. If they believe that its "discriminatory" then that's what they believe and its their policy. |

Hey, Pat. Tell them that you want your ad placed, and you want it to read as you want it. If they wish to add anything else to it, when you are brought to court due to the fact that you didn't live up to what was put into your ad, tell them that the newspaper demanded for that to be in there, therefore you wish to have a claim against them for it. Ask the judge to throw out the case against you immediately, and tell the plaintiffs that they'll have to go and talk to the paper regarding what THEY printed. |
