Town assessor fights end of term
Board ruled staffer to leave in Dec.

    When town officials appointed John Macejka Jr. as the town’s parttime assessor in January, they never indicated for how long.
    That was until last month, when they passed a seemingly harmless resolution indicating that his term would expire at the end of the year. Macejka quickly moved to correct the record, claiming his tenure would extend through former assessor Craig Surpise’s six-year appointment in 2013.
    “It’s a term appointment,” he said Thursday. “There’s no way around it.”
    But some Town Board members aren’t convinced. Both Nicola DiLeva and Robert Godlewski contend Macejka knew the appointment was only for a year, due to the trial nature of having the town’s first part-time assessor in recent memory.
    “It has nothing to do with John Macejka,” DiLeva said.”It has to do with the fact that every single applicant we had knew it was for a trial year.”
    Only Macejka and Supervisor Frank Del Gallo believe his appointment couldn’t have been for less than the remainder of the term. And state officials basically agree.
    Geoff Gloak, a spokesman with the state Department of Real Property Services, said a town can either appoint an assessor to the remaining term or can appoint an “acting assessor” for a six-month period until that person can achieve the necessary certifi cations prescribed by state law.
    Macejka, the full-time assessor in Guilderland, already has these requirements. Gloak said that likely means his appointment would need to be for the remaining term.
    “Its not our role to get in the middle of this,” he said. “We would defer to the town attorney unless he asks us, and then we would have our own attorneys give an opinion.”
    Macejka’s partial-term appointment is his second with the town. He came to the position on an acting basis in 2003 after two appointees resigned in a span of six months.
    The Republican-controlled Town Board opted to hire Surprise in 2008. They later passed an agreement that paid Macejka about $8,000 for 259 hours worth of vacation leave he had banked while employed between July 2003 and December 2007.
    Only Surprise didn’t last long. The new board under the Del Gallo administration halved his pay, prompting him to work out a cash payout of $12,800 in exchange for resigning his position on December 31, 2010.
    Macejka was hired to work about 17.5 hours per week, staggering his office hours before and after his time in Guilderland. He earns a salary of $33,305, but receives no benefits or retirement credits from the town.
    Board members were expected to take up a resolution extending Macejka’s tenure to 2013 during their meeting Wednesday. The matter was tabled, however, so the town attorney can review the legalities.
    If Macejka remains assessor, it would basically ensure the town continues to run with a part-time assessor for the next two years, even if a new administration comes into office in January. Del Gallo said he personally believes having Macejka as a part-timer has worked out fi ne, since there are three other workers in the office to assist residents when he’s not at Town Hall. ......................>>>>......................>>>>.............................http://www.dailygazette.net/De.....r01603&AppName=1

Exactly what hours does this clown work at Town Hall???

And if he can do the job PT now....shouldnt he pay teh town back for all the years he was "full-time"   he obviously wasnt there working back then!

I think he was brought back because he never wanted to leave.  Tommasone should've kept him. Steve would still be Supervisor, still had his state job and Gerard would've still been outsourcing legal work to his brother!!!  And John Mertz would have still been put out to pasture.  No wonder Macejka is eating at the Wagon Wheel, he slayed the pigs that FDG is serving up.

Wow this Maceka sure has a big opinion of himself......and the only pig seems to be him taking pay from the taxpayers for not doing work.  What exactly are his hours at Town Hall....I think this needs to be inspected on a regular basis.  Does he fill out time sheets in Rott or in Guilderland?

Skip the papers.......those can be easily 'modified'.
