Techdirt reports that Senate bill 978 – a bill to amend the criminal penalty provision for criminal infringement of a copyright, and for other purposes – may be used to prosecute people for embedding YouTube videos.
According to Mark Masnick, if a website embeds a YouTube video that is determined to have infringed on copyright and more than 10 people view it on that website, the owner or others associated with the website could face up to five years in prison.
Read Masnick’s article here. He explains how the new law would expand copyright violations from reproducing and distributing to performing – including streaming video over the internet.
As readers of Infowars.com know, many videos are removed from YouTube after copyright owners complain about infringement. This happens with thousands of news clips every year. Most people are familiar with the now common black box replacing a video that says the video has been removed for copyright reasons.
If enacted, this law will go one step further and turn people who embed a copyrighted video into criminals. It will also set the stage to criminalize linking to copyrighted information — like corporate media news sources — and shut down the alternative media.
It will also make people think twice about putting up all kinds of videos, from news reports to clips from documentaries and other educational material.
I thought youtube has an option to allow or disallow embedding.....no? I've been on youtube where embedding isn't allowed. So I'm confused.

Sounds like a good idea -- youtube videos are the private property of youtube -- and any unlicensed use of them should be punished severely.

DVOR Here are the terms from youtube, as you can see if you can embed a video anyone is allowed to use it except for commercial use without youtubes permission.
4. General Use of the Service—Permissions and Restrictions
YouTube hereby grants you permission to access and use the Service as set forth in these Terms of Service, provided that:
1. You agree not to distribute in any medium any part of the Service or the Content without YouTube's prior written authorization, unless YouTube makes available the means for such distribution through functionality offered by the Service (such as the Embeddable Player). 2. You agree not to alter or modify any part of the Service. 3. You agree not to access Content through any technology or means other than the video playback pages of the Service itself, the Embeddable Player, or other explicitly authorized means YouTube may designate. 4. You agree not to use the Service for any of the following commercial uses unless you obtain YouTube's prior written approval: * the sale of access to the Service; * the sale of advertising, sponsorships, or promotions placed on or within the Service or Content; or * the sale of advertising, sponsorships, or promotions on any page of an ad-enabled blog or website containing Content delivered via the Service, unless other material not obtained from YouTube appears on the same page and is of sufficient value to be the basis for such sales. 5. Prohibited commercial uses do not include: * uploading an original video to YouTube, or maintaining an original channel on YouTube, to promote your business or artistic enterprise; * showing YouTube videos through the Embeddable Player on an ad-enabled blog or website, subject to the advertising restrictions set forth above in Section 4.D; or * any use that YouTube expressly authorizes in writing.
(For more information about what constitutes a prohibited commercial use, see our FAQ.)
And it is the 'owner' of the video that can enable or disable embedding!

The videos certainly don't belong to idiots like you how "steal" them from the website and then post them here or elsewhere.
And idiots like you should be thrown in prison for stealing the property of others when you post such videos.

You agree not to "distribute" -- and posting it on another website is 'distributing" it. Pass the law -- make it a felony -- and put the stealers behind bars where they belong.

You still don't get it do you?
The owner of the video can 'DISABLE' the embed option!!!
That is the 'owners' choice AND responsibility!!
OMG!!!

Government loves it because would make people afraid to put up all kinds of informational videos and it would also help shut down alternative media and citizen journalism. This would leave only the privileged media to cover the government’s activities.
We all know how well the establishment media presents news and information. So this is not good news.
Clearly there is a political war going on to attempt to stop people from presenting information and sharing things with each other. You can’t be friendly and share your Netflix account in Tennessee anymore. And now you might not be able to use YouTube to do anything other than waste your time with nutshot videos for fear of the copyright brigade coming after you.

If youtube was against it, they wouldn't offer it for EVERY video uploaded. If the video author doesn't want it to be seen, except by a small audience, they'd restrict the embed code (also an option on every upload). Fact is, sites like CBS, ABC, MSNBC, CNN, Fox ALL offer embeded videos - it enhances their brand and gets people talking about not only the topic - but "I saw it on Fox" or "CNN has this cool video" ... it's enhancing their reach.
Even Dumbkovich likes to post fox news videos - it gives him a warm tingly feeling.

Actually , I do get it. The video does NOT belong to the people who are "stealing" them and posting them on other websites.
I have a right to my opinion - and I prefer to protect the intellectual property rights of the people who post the videos.
Oh - and for the other idiot who claimed I support censorship -- that statement is untrue -- as I said nothing to favor censoring the content of the videos themselves.

.
DV, NO NO NO NO NO NO NO! You do NOT get it!!!!!!!!!!!!
Try to comprehend what you read. An example. Let's say I take a video----it could be lightning, it could bea family picnic, it could be a parade, it could be friends doing karaoke, it could be a city snowplow weaving in and out of illegally parked cars, it could be a dolphins going by on a dolphin watch cruise, it could be a presentation made at a government meeting or a someone speaking at a government meeting. I post it on youtube.
1. "Youtube" does NOT own the video. I do. Got that?????
2. When I post it on Youtube, I CHOOSE to allow embedding. ANYONE on these boards has the legal right to repost that video on these boards. Go that?????
It is MY CHOICE. It must NEVER NEVER NEVER NVER NEVER become the choice of the government to make a law that dictates that people on thise boards are prohitibed from re-posting/posting links to a video that I ALLOW to be posted. GOT THAT????? Do you understand?????
And by the way, anyone wants to videotape you talking at a government meeting, post it on youtube and that person ALLOWS embedding, then EACH AND EVERYONE on these boards can repost or post a link here to put a video of you on these boards. GOT THAT???????
What is not supposed to be posted, and often is, would be, as example, if someone brought a camera into Proctors, filmed from a show and then, well, even posting on youtube in theory would be a copyright violation, I mean, one is not even supposed to take photos in most performances in theaters. When you think locally, I would say Proctors, the Palace, SPAC, and the like this would apply to. But I think if you went to Alive at Five, or the 4th of July stuff at the plaza, or even something in Schenetady downtown or Central Park, those would not be copyrighted so it's legal to post on youtube, and then, the poster is the one that makes the choice to allow it to be reporsted/linked.
And by the way, when people take videos, they do not become copyrighted anyway.
Optimists close their eyes and pretend problems are non existent. Better to have open eyes, see the truths, acknowledge the negatives, and speak up for the people rather than the politicos and their rich cronies.
