Nursing homes sue NY over Medicaid The Business Review - by Tracey Drury, Contributor Date: Tuesday, March 29, 2011, 9:05am EDT - Last Modified: Tuesday, March 29, 2011, 2:22pm EDT
Nearly 100 nursing homes across the state have joined a lawsuit aimed at claiming funds owed by New York for increased Medicaid reimbursement rates. The suit was filed March 21 in state Supreme Court against Dr. Nirav Shah, commissioner of the state Health Department, and Robert Megna, director of the state Budget Office. The legal action seeks to enforce a 2006 law designed to bring Medicaid reimbursement rates into the 21st century. Nursing homes in the Albany area that have joined the suit include Daughters of Sarah Nursing Center, Teresian House, The Avenue Nursing and Rehabilitation Center, The Dutch Manor Nursing and Rehabilitation Center, Kingsway Arms Nursing Center Inc., The Springs Nursing and Rehabilitation Center, and St. Peter's Nursing & Rehabilitation Center. Nursing facilities statewide are currently receiving reimbursement dollars based on 1983 rates. The Reimbursement Reform Act of 2006 brought those rates up to 2002 levels and was scheduled to go into effect in 2009. Though the federal government approved the change, the rates have not yet been adjusted............................>>>>................................>>>>............................http://www.bizjournals.com/albany/news/2011/03/29/nursing-homes-sue-ny-over-medicaid.html
Notice that Schenectady County with their up to date facility thinks that they are getting the appropriate payments from the state government... either that, or they don't want to steal from their own wallet. Imagine if they weren't in the business.
and the FEDS just went around doing a shake down.......welcome to Atlas Shrugged.......either kill the giant or we will all become a vegetable in the pot of soup it eats.......

Is this how they are trying to get people out of nursing homes? By paying them so little they can't afford to stay open?
And the idea of closing nursing homes and having people at home, well here go our county taxes because the gov said no more will the state pay visiting nurses (among a few other things), and if the counties can't afford it, what happens to the elderly? Families can only do caregiving during the hours they don't work themselves.
I know a few people locally that were sent just about 75 and 100 miles away to a nursing home, one was even out of state, because there were no available beds closer. I don't know what we'd do if our parents were ever in nursing homes. You can't be in two places at one time and it's very very bad for a patient to have a visit from their family only once a month or once a week.
Optimists close their eyes and pretend problems are non existent. Better to have open eyes, see the truths, acknowledge the negatives, and speak up for the people rather than the politicos and their rich cronies.
oh....it's strong arming the nursing homes.....by a bunch of gangsters that sit around an octagon table and write things in bracket format.....they use nursing homes/schools and anything that would 'make the plebs feel bad' as podium pucks.....here's the deal....I cant afford you and you cant afford me and when the government is in the business of 'feeling' for us, we get into trouble and the facts/$$ get all cloudy behind our tears....
people have what they have because they have what they have....the problem lies within' the machine of the 'equalizer' government which is a FARCE

If nursing homes close, where to the elderly go who need the skilled nursing services? Especially since, in NYS, the governor said no more state giving money to the county to pay for visiting nurses.
People who need skilled nursing services won't have a nursing home, and no assistance from government to pay for visiting nurses. How will people receive such services if their heallth insurance doesn't cover it and medicare has terribly limited services.

the 'needed services' are what will be deliberated.....we will be weighed every election cycle....that is why the government shouldn't ever be in the position as caretaker nor held to that kind of standard....it's a MACHINE....inefficient and poor....it has no soul or standard of it's own other than monetarily.....there is no such thing as 'pre-emptive' caretaking.....are there crappy places? sure there are, does the government get rid of them---yeah,,not really.....they 'penalize' via $$$$$$$$$$$$$$$$$$$
we are what we are and we have what we have.....
all this talk about 'aging in place' like it's a new freakin' concept.....the only reason it has a title is because now $$ has to be thrown at it so help can be paid.....aging in place is as old as the earth until a generation ago....I dont know what happened and I really dont care.....I say outsource ,,, that's what Rome did
