Pedestrians and bicyclists with cellphones and portable music players are the new targets of public-safety bills recently introduced in four states, The New York Times reports. Fueled by incidents of distracted people stepping — or cycling — smack into vehicular traffic, the legislation would restrict or ban non-motorists from operating their mobile devices while navigating streets.

“The big thing has been distracted driving, but now it’s moving into other ways technology can distract you, into everyday things,” said Anne Teigen of the National Conference of State Legislatures.

The New York bill orders pedestrians to put aside their handheld gadgets while crossing streets. Bills in Oregon, Virginia, and California seek to curb bicyclists with similar electronic devices and impose fines for violations.

There it is fines and violations, just another way to collect revenue. I would hate to see cops trying to enforce this knowing full well this is a attack on our liberties, I'm sure they will though considering they enforce hundreds of unjust laws everyday.

I think a little of both but stupidity shouldn't be a crime unless it infringes on another's rights and then it should only apply for that person. Personal safety used to come through personal responsibility but not no more, now the government believes safety can only be obtained by the rule of law even if unconstitutional or unjust.

If I'm texting while walking and walk in front of a car............guess what.......that becomes my stupid responsibility. I'M RESPONSIBLE! It's called personal accountability. It's called 'my fault'.

The government is trying to 'unconstitutionally' protect us from ourselves! Bullcrap!

So if a guy walks down the street with his pants down to his knees, with his underwear hanging out....and......a girl is walking down the street with her 'everything' hanging out....and.....a driver glances over to look at the view and gets in an accident, will there then be a law for 'driving while gawking'?

Sound ridiculous? So does 'texting while walking'.

Can I throw a question out.

Yes, if you get hit by a car when texting while you are walking in the road, yes, it's on you.

However, if I'm driving, and I see you and I swerve to avoid you, and in doing so, I ram into another car and kill a passenger or, I jump the curb and hit someone on the sidewalk killing that person, or I slam on my brakes and the person behind me rams into my car and the person behind or his passengers are severly hurt, or any kind of occurrence like that, what happens?   Other innocent people can get hurt or killed.

It's like the punks that have their radios up full volume in the car.  SHould there be a law against that?  Damn right there should be.  It doesn't seem like it would affect anyone.  However, then an emergency vehicle is approaching from around a corner at an intersection, and the punk with the radio so loud can't hear the siren and they proceeed through the green light, they really could hit the emergency vehicle, which can cause loss of life.

THere are those who say not to have laws about helmets on motorcycles.  Fine if you drive without a helmet, it won't hurt me, it won't affect me, right?   No, it can affect me and anyone else around.  All you need is for a stone or something to go flying, hit you in the head, causing you to swerve, lose your balance, fall off, whatever. and what happens?  Those around you can get hurt.

I don't know, if legislation like this is intended to try to protect us from our own stupidity, then the legislation can be viewed as stupid.  If our stupidity can cause the injury or death to others, then should there be a law?   What's the difference between a burglar coming in to your house and stealing from you and someone texting and not paying attention and causing an accident and hurting you.  The actions of the burglar are against the law simply because someone initiated some legislation sometime in history.  And if you aren't in the house at the time, you're not physicially hurt.

THink about this scenario.  Some kid on welfare is texting while walking and doesn't pay attention to oncoming traffic.  I'm driving and swerve to avoid hitting that kid but in doing so, I hit you.  You wind up very severely injured.  Who pays your medical expenses?   If you were in your car and I in mine, well, our two insurance companies will do their research, and you can't possibly be at fault because I "suddently" cut you off.  So, is it my insurance that pays?  And while it really wouldn't come out of my pocket, what happens to my insurance?  The premiums go up because of some punk kid on welfare.  Can I sue DSS for damages?   If you have auto insurance but they dont pay, and you have good health insurance but it won't pay because it was auto related, what happens?  You go on welfare so medicaid can pay and you and your family lose your house?  

Somewhere along the line someone is going to pay.  You and/or I might pay as individuals via higher premiums.  But then, our premiums won't nearly cover your medical costs.  So insurance plans raise premiums on everyone.  

Bottom line, it's a difficult issue to say should there or should there not be a law.  Now, how about roll cages in cars

Better to have open eyes, see the truths, acknowledge the negatives, and
speak up for the people rather than the politicos and their rich cronies.

Laws don't fix stupidity and the government can't fix stupidity, better yet neither can protect us and never have. There is so many laws on the books I can guarantee everyone here breaks the law at least once per day, you might not know it but I bet you do. If you drive I can bet once during your daily commute you pass the speed limit even if just 1 MPH. That might not sound like much but guess what under the law you broke it, should you be fined for that or should common sense be used.

I'm not saying there shouldn't be laws but in a free society there will always be risks. I guess it depends to you if you wish to give up some freedom for a false sense of security, I would argue that throughout history whenever the people made that trade off they lost both.

I understand that you believe some laws are ok because it may serve the better of the community, however that argument has been used to strip us of many rights including the rights to our own body. The best example to date of that is the war on drugs, I don't condone the use of drugs but should it be up to the government to decide what we put into our bodies. Ever since we gave the ok to that they believe they now own our bodies, now they wish to control what we eat, drink, smoke, consume and they do it by the passing of laws.

I brought that up just because it shows what a failure feel good laws are. The war on drugs has claimed more victims than the actual drugs themselves. Just like Prohibition of alcohol created the Al Capones, the drug laws created the Mexican Cartels and your violent drug dealers. The laws that were put into place to protect ourselves only made it 10 times worse.

Henry is spot on .. you can't pass laws to stop people from doing stupid things.   If they did they would have
passed a law against voting for Republicans years ago.

Meh, the same can be said about democrats and pretty much anyone who votes on party lines alone. Jesse Ventura actually brought up a good idea not to long ago, remove what party the person is running for next to their name on the ballot, maybe then the people would pay more attention to policies

Detroit has "non-partisan" elections for city offices.   It is a mixed bag as to whether that is a good idea or not.
Most of the people who are elected turn out to be registered Democrats anyway -- and it is not as if the city has been well run for the past 35 years or so.    I believe that the last registered Republican to be elected Mayor of Detroit was in the 1960s.
