this is what the judge really did: In contrast, Judge David O. Carter seems a more patient sort. He is giving Orly Taitz explanations as to what she does wrong, and even tried to assist her in accomplishing service. He is going through all the forms including scheduling a trial date, even though there may be no trial. Whatever his personal view of the merits of the lawsuit, he is acting in a very measured and objective fashion. On the one hand he promises not to summarily dismiss the case on a technicality (giving glee to the Orly tribe) but on the other hand suggesting that there will be no discovery until the motion to dismiss is dealt with, and leaving a none-too-subtle hint to the US Attorneys that a motion to stay discovery might be in order. [I think part of the confusion here is on the definition of technicality. I suppose failure to meet a deadline for service is technical for one side, and not having standing is considered technical by the other.]
Carter’s even-handed language may lead those of us itching for resolution (either trial or dismissal) to read too much into his statements. In the end, I am confident that he will follow the law, and Orly, if she pays attention, might get a bit of a legal education in the process.
Fed. Judge Carter sets Trial Date for Obama's Eligibility
The expedited trial has been set for Jan. 26, 2010, just 4 1/2 months from now!
I and many other concerned veterans and citizens attended the hearing today in Federal Court in Santa Ana in the lawsuit against Barack Obama to determine his eligibility to be President and Commander in Chief. About 150 people showed up, almost all in support of the lawsuit to demand that Obama release his birth certificate and other records that he has hidden from the American people..
Judge David Carter refused to hear Obama's request for dismissal today, instead setting a hearing date for Oct. 5, since Obama's attorneys had just filed the motion on Friday. He indicated there was almost no chance that this case would be dismissed. Obama is arguing this lawsuit was filed in the wrong court if you can believe that. I guess Obama would prefer a "kangaroo court" instead of a F ederal court! Assuming Judge Carter denies Obama's motion for dismissal, he will likely then order expedited discovery which will force Obama to release his birth certificate in a timely manner (if he has one).
The judge, who is a former U.S. Marine, repeated several times that this is a very serious case which must be resolved quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military in this time of war. He basically said Obama must prove his eligibility to the court! He said Americans deserve to know the truth about their President!
The two U.S. Attorneys representing Barack Obama tried everything they could to sway the judge that this case was frivolous, but Carter would have none of it and cut them off several times. Obama's attorneys left the courtroom after about the 90 minute hearing looking defeated and nervous.

Taitz, a leader of the "Birther" movement that does not believe President Barack Obama was born in the United States, on Monday asked the U.S. Court of Appeals, 11th Circuit in Atlanta, to review Land's Oct. 13 ruling.
Land's rebuke stems from a Sept. 17 motion Taitz filed on behalf of former client Capt. Connie Rhodes, who sought to halt her deployment to Iraq on arguments that Obama couldn’t legitimately hold office.
Land denied the motion and Rhodes, an Army surgeon, was deployed.
Land told Taitz the previous day that she could face sanctions if she ever again filed a "frivolous" suit in his court. When Taitz filed the motion for emergency stay, Land gave Taitz two weeks to explain why he shouldn't sanction her $10,000

The House sponsor of legislation that would require presidential candidates to provide a copy of their original birth certificate is praising a similar Arizona measure, which is drawing condemnation from one of George W. Bush’s former White House press secretaries.
Rep. Bill Posey (R-Fla.), sponsor of the House bill, which has attracted 11 co-sponsors, said an Arizona House-passed measure would help clarify murky guidelines about presidential eligibility.
The measure, adopted 31-22 earlier this week as part of a separate bill, would require President Barack Obama to show his birth certificate if he hopes to be on the state’s ballot when he runs for re-election. It would require U.S. presidential candidates who want to appear on the ballot in Arizona to submit documents proving they meet the constitutional requirements to be president.

The article is saying that the law will make any future candidate prove that he/she is qualified to be President of the USA and eliminate what happened after the 2008 election to prevent future problems.
The candidate has to prove it before they file paperwork anyway. LOL, any extra legisation is for the morons to feel more comfortable. Glad we need more laws in this country.
What started the whole birth-er thing was Obama's' grandmother saying that she attended his birth and she has never been out of Kenya. This is a state law to enable Arizona to check the paper work for themselves instead of taking someone else in the Federal Governments word that a candidate is qualified.

But he is so incensed over “birthers” — the conspiracy theorists who assert that Mr. Obama was born in Kenya and was thus not eligible to become president — that he is seeking ways to change state policy to allow him to release additional proof that the president was born in Honolulu in 1961.
“It’s an insult to his mother and to his father, and I knew his mother and father; they were my friends, and I have an emotional interest in that,” Governor Abercrombie said in a telephone interview late Thursday. “It’s an emotional insult. It is disrespectful to the president; it is disrespectful to the office.” The governor, a Democrat and former congressman, said he has initiated conversations with the state’s attorney general and the chief of its Health Department about how he can release more explicit documentation of Mr. Obama’s birth on Aug. 4, 1961, at Kapiolani Maternity and Gynecological Hospital. He said he has done so of his own accord, without consulting the White House, which declined to comment.
“He’s a big boy; he can take sticks and stones. But there’s no reason on earth to have the memory of his parents insulted by people whose motivation is solely political,” Mr. Abercrombie said. “Let’s put this particular canard to rest.” Mr. Abercrombie was regarded as an independent operator in Congress, a free spirit who embodies his state’s “aloha” tradition of inclusiveness and harmony.
He returned a reporter’s phone call at 11:30 p.m. on Thursday — he had just gotten the message, he said, and was worried about deadlines — and spent 30 minutes chatting animatedly about Mr. Obama, Hawaii and his own recent election, saying that he had based his campaign on “our diversity defining us rather than dividing us” — much the same message that Mr. Obama used in 2008.
Now that he is in office, Mr. Abercrombie is facing a $71 million deficit this year and 10 times that amount in the years to come. Mr. Obama talked about the problem at a news conference Wednesday in Washington when he spoke, imprecisely, about “schools that are laying off so many teachers that they start going to four days a week, as they’ve done in Hawaii, for example.” In fact, Hawaii instituted furloughs to avoid layoffs.
