Candidate no longer sworn officer
Certification not required to hold sheriff’s post

    Schenectady County sheriff’s candidate Joseph Lazzari, a retired police detective, is not a sworn police officer under current state law and would have to take a refresher course to reclaim his police powers.
    The elected position of sheriff is primarily administrative and does not require the holder to be a sworn police officer, however, said County Attorney Chris Gardner. Without police powers, the sheriff cannot carry a weapon under his badge or make arrests.
    Lazzari is a member of the Independence Party, running with the endorsement of the Schenectady County Republican Committee in the Nov. 4 election to fill the vacant office of sheriff. He faces Dominick Dagostino, a Conservative running with the endorsement of the Schenectady County Democratic Committee.
    Dagostino is a lieutenant in the Rotterdam Police Department. He is eligible to retire in August but has not discussed it with his employer, he said.
    Should he retire in August, he also would no longer be a sworn police officer under state guidelines. On Monday, he said, “It would be my intention to maintain my sworn police officer status.”
    Should Dagostino, 42, win the election in November, he would immediately return to sworn duty status, according to the state Division of Criminal Justice Services.
    Lazzari, 60, retired in 2004 from the Schenectady Police Department after 26 years. He has not held another law enforcement position since retirement, according to the DCJS.
    Harry Buffardi, a Democrat, resigned Feb. 27 as sheriff to become a full-time professor at Schenectady County Community College. Buffardi was midway through his third term.
    Under state law, retired law enforcement officials maintain their certification for four years. After that, they have a further six years in which to take a 519-hour refresher course to maintain their status. After 10 years, they have to take a 639-hour basic course at the police academy.

Lazzari gains support of Independence Party
Also has Republican line in run for county sheriff

    The Schenectady County Independence Party Wednesday night unanimously endorsed retired city police detective Joe Lazzari for sheriff and Robert Carney for district attorney in November’s general election.
    Lazzari, 60, is a member of the Independence Party running on the Republican ticket; Carney is a Democrat.
    Party Chairman Richard Nebolini said the party’s executive committee endorsed Lazzari because of his resume. “I and my executive committee have reviewed many, many resumes through the years, and Joe’s resume was impressive,” he said.
    “We looked at his career in the police department and various things he has accomplished in the police department. The fact he was a Vietnam veteran was impressive as was his service in the community and his many years in the Air National Guard,” Nebolini said.
    The Independence Party’s endorsement gives Lazzari a second line on the Nov. 4 ballot, in addition to that of the Republican Party. The Schenectady County Republican Committee endorsed Lazzari in April.
    The Independence Party is the largest of the minor parties in both the county, with 3,400 members, and in the state.
    Lazzari’s opponent is Dominick Dagostino, 42, a lieutenant with the Rotterdam Police Department. He is the son of prominent Democratic county legislator Judith Dagostino, vice chairwoman of the county Legislature.
    Dagostino also expects to have two lines: that of the Conservative Party, of which he is a member, and that of the Democrat Party. The Conservative Party has yet to announce its endorsements, but Chairman Randy Pascarella said Dagostino has the party’s support.
    Dagostino had sought the endorsement of the Independence Party. The Working Families Party, the last of the minor parties, has yet to announce its endorsement for the office.
    The race to replace former Sheriff Harry Buffardi, a Democrat who resigned Feb. 27 to become a fulltime professor at Schenectady County Community College, is the first in memory in which candidates from minor parties are leading a countywide ticket with support from the major parties.
    Money will play a major role in this election, with Nebolini estimating the race to cost at least $60,000. ESPN analyst Marcellus Wiley has been in the news lately for his comments on various situations in the NFL.



Wiley, the former Pro Bowl player and Columbia University grad, stated on Sunday that the Pittsburgh Steelers might cut cornerback Anthony Smith for talking too much. Smith guaranteed a victory against the undefeated New England Patriots.



Wiley said that if he were one of Smith's teammates, he would "take him to the showers and beat him up a little bit".



Two weeks ago, Wiley said that NFL players were targets, which was the primary reason for the murders of Washington Redskins safety Sean Taylor and Denver Broncos defensive back Darrent Williams. However, Kansas City Star columnist Jason Whitlock disagreed and mentioned Wiley's comments in a very controversial column, in which he referenced the "Black KKK".



Wiley responded saying that Whitlock not only lacked tact and class, but was on the outside looking in, while Wiley, a resident of inner-city Los Angeles and Ivy League graduate, knew both sides of the fence. Wiley mentioned that he has had teammates that were murdered and that his comments about Taylor are based on his 10-year NFL experience.



Wiley is a football analyst now on ESPN for shows such as "NFL Countdown" and "ESPN First Take".
